I just received a court order last night February 27th at 4:30 p.m.
to be in court next Thursday March 6th at 1:00 p.m. This was filed on January 13, 2009 and i am just know receiving it. The Attorneys are Bowman, Heintz, Boscia and Vician Merrillville, IN.
They received a judgement against me at least 3 years ago for $10,566 and some change. This is for a unsecured credit card of Bank One. Somehow they found out that i was recently employed by CVS. Which they have sent Interrogatories to. I only work 2 to 3 hours per week for them as a Merchandiser. My W2 for the year is $278.00. I have no savings,
very little in my checking account. I have no investments. The only thing i have is a home which i jointly own with my husband.
I cannot afford an attorney. Could you please tell me how this works and what are my options. Since the credit card was in my
name only and the judgement is in my name only is there anyway
they can come after my husband?


Is that the only job you have, or is that just the only one they know about? They're not going to be able to garnish that income (CVS) because it doesn't meet federal requirements.

They can't do anything to your husband because they don't have a judgment against him.

Sounds like the most they can do is put a lien against your house, in which case you won't be able to sell or refinance your house until the lien is paid off.

Keep in mind, the judgment earns interest, usually at 9-12%. You might not have to pay them now, but 10 years from now if you go to sell that house, you might find that your $10K balance turned into $20K with all the interest. And you'll have to pay that if you want to sell the house ever. (Or else going bankrupt is the only other way to wipe it out.)

That is the only job they know about. I have another job - it too is a
part time merchandising job. The w-2 from last year was 2400 (twenty four hundred) and some change. We are not planning on selling or refinancing our home. This is
probably where we will be for a long long time. Thanks for the info.
I did find out that this firm of lawyers has been successfully sued many times because of less than above board practices.
