Summons and Complaint received - No Case Number???

Greetings,

I received a Summons and Complaint from an Attorney here in Seattle for a credit card debt owed to Capital One. The attorney gave the standard "this is an attempt to collect a debt" in the Complaint. In addition, they didn't even provide our complete account number.

My question is this. I have prepared our four legal docs to send back to them certified mail (I've done my homework on this one). However, since there is no Case number, do I need to go the the County Court to file the docs? Or is sending them to the Attorney Certified Mail / Return Receipt enough?

Any clarity from those that are experienced in this?

These are more than likely not real court documents, generally they don't put "this is an attempt...." in court docs.
Also court docs that have been filed have the court STAMP and case number on them.

I would call/visit the court to see if they are legit. If they are then you file with both the court and the attorney.

If they aren't, which is most likely the case, ask the court if they violated the law and send them a DV letter, CMRR, and wait to see what they do next.

Is this the first contact you have had from this attorney?

We've received letters from them in the past, but we haven't done anything about it because we were waiting for our nearly foreclosed house's short sale to finalize. We are afraid to do anything until the house deal closes...we don't want to lose that!

The summons and complaint look valid, but like I said, there is no case number at all. They are an attorney group here in Seattle and have been discussed on the board before.

I found some paperwork where they had our original account number. It was a settlement offer sent a week and a half prior to our receiving the Summons / Complaint. Ironically, the Settlement offer ends on the day that the 20 days of the Summons / Complaint ends too. Why would they not include the full account number in the Summons / Complaint when they put it in past documentation? Laziness?
