1. Send them a letter with your bill that asks them to consider the changes you are requesting to the terms & conditions. You send a payment, for your normal monthly payment & whatever you have over due. This shows your compliance with the current terms and conditions. You attach a second check for 10 bucks with terms and conditions attached to it. The new terms can say you want 0% interest and 10 dollar minimum payments from now on. You give them CMS's name and address and tell them if they accept they now have to deal with CMS. You should be clear in stating that you are trying to negotiate your terms and that they are not in any obligation to accept them. If they deposit your check then they are accepting the new terms attached.
Tom321 has said before that you can’t do this. But I have in the past. I have sent proposals for term negotiations. I have asked credit card companies to consider changing my interest rate from 20% to 10% and they have been accepted successfully even though my terms say that I can’t send them letter requesting changes. You can always negotiate terms & conditions, which is part of contract law.
2. If the cc company deposits the second 10 dollar check it shows ACTION to the agreement.
3. If the cc company starts sending bills to CMS or whoever is working on your behalf this also shows ACTION to the acceptance of the new terms.
4. If the cc company continues to accept all of the 10 dollar payments from CMS from the bills they have sent to CMS this shows long term ACTION.
5. If the cc company does items 1, 2, 3, & 4 then it is reasonable to assume they are in agreement with the new terms and conditions. This seems like a very good argument in court. The question is will the cc company do this? CMS and other claim they do.
I have not tried this program but I am seriously contemplating it. My best friend has been telling me that I should try this program to get rid of my debt, but I felt that it was dishonest and did not want to pursue it. After I heard the pitch it did not sound so shady just plain contract negations. My best friend personally knows an employee that works for Integrity Debt Relief Group, which may be a branch of CMS I am not sure. But they are basically selling the same service. There office is local, I can walk in and say hello. My best friend has known this employee of Integrity Debt Relief Group for 20 years, and they are good friends. Everything I have heard from my best friend says this is legit. I’m not using names because I have not asked their permission to do so. If I do join I will make the names known and let you guys know how it’s working out. I have a close connection and can see these guys face to face.

thanks so much for your post and please let me know what you find out , i too have credit card debit and i have never been late yet every bill i recieve my interest rate is hiked up . I have played by the rules and they are not !

in theory i could see how this could work, but if more and more people are doing this, im sure they are starting to look for it wouldnt you think? Its sneaking in through the back door. Not that they dont deserve it, but im just saying the more common a program like this becomes, the more they are going to look for it and not cash it or agree to it. Not that im oppossed to a new program for debt negotiation because it would be great to have more options.

The theory is flawed....it is simply restrictive endorsement which doesnt hold up in court in many states. Sure some companies will lower an interest rate...but the nominal payment wont hold up. Most parts of your card holder agreement are not negotiable and following those steps will just end you up in further debt.

Soaplady - This company exists and has an office near by where I live. I am going to see if I can get a hold of some satisfied customers and see what they say. It may be flawed but if it works, thats good enough for me. I will talk to their employee my best friend knows face to face to get a better understanding on how all this works. I will post my updates.

I think its very important that people read toms post so that they are aware of all sides of this arguement.
Im not sure why you did not just comment to toms posting if you feel that this program really is what it says instead of a new post. If you feel that strongly about how it works and that it is effective, than you could have discredited what he said and posted.
Im not saying that it dont work, but i feel when it comes to financials people should see all the sides and be confident about there decision that they make. If they read this post and toms post, and still are ok with it, then its thier decision to make.
