Yes, you may need an attorney. These people won't listen to anyone but a judge, it seems. Get an FDCPA/FCRA attorney. File a complaint with the FTC also.

No problem. It bothers me that such low-life bottom feeders are allowed to continue ruining lives with lies for ill-gotten gains.
I do hope you have a settlement letter also, you weren't clear on that. If so, good. You might even file that FTC complaint as against the CRA too. They are required by the FCRA to include only accurate information and must remove false information as soon as it is pointed out to them.

thats what i suppose to have recieved after the funds was cleared thru them..didnt get that nor a letter saying I owed more..I am just on the up's with my credit report due to wanting to own property soon..so thats how I realized they updated my report saying I owed them..and I didnt think to much because the other companys I owed said they would send settlement letter as soon as payment goes thru and they did with no problem. So, the only proof I have for this company is the settlement offer letter and my copy of funds being paid to them thru my bank...so, I guess I will see if they will respond to my letter that I am sending out tomorrow in regards to giving me a detailed info on amount still stating I owe on credit report..

It's interesting to read posts about these sleeze balls from other people...here's my story - as most of you probably know, speigel-fcnb bank went out of business in the early 2000's and midland is the collection agency of choice for them. I had two accounts with them way back - one was a visa card and one a speigel consumer card. Both were paid in full at the time of my divorce in about 2004. In February last year, I pulled my credit reports, as I do every year and discovered debt to the tune of 5,000 in one entry, 8,000 in another and 3,000 in yet another! All from - you guessed it - Midland Credit Management.
So I wrote a letter to the address on the credit bureau mail page asking for proof of those accounts and asking them to contact me with regard to the entries on my credit bureau reports. No response, until WHAM! Last fall I get served papers to appear in court. Right off the bat, i noticed in the paperwork that they were suing me for a Mastercard account - so I contacted my old bank and asked them to dredge up old checks (thankfully I always used quicken back then and always wrote the account number on the memo line of all checks printed, yay!). I went to court with them, told the judge I could prove that wasn't my account. I filed 'discovery' paperwork, asking that they come up with official documents about the Mastercard account in question, to which THEY filed a 'protective order' in court asking not to have to provide them. I filed papers objecting to this motion, and the judge sided with me on this point and ordered them to produce the documents. The trial was scheduled out about two months, so in the meantime, I got online, went to the Missouri Attorney General's website and pulled up page after page of consumer complaints on MCM. I had my case all lined out and was ready for them, as I knew they would not be able to prove the account was mine. The day before court, they dismissed the case against me. Three months has gone by now, with me feeling victorious, but that was a mistake. Now the entries are on my credit bureau report FIVE times, which makes it look like I owe them over 40K, when I don't owe them a freakin dime. So, yesterday I get TWO letters - one telling me I can settle the account for five THOUSAND dollars, and one in response (after a year) to my letter to them asking for info about the entries. I called the number on the second letter, hoping to talk to someone who would help me gain access to the account information for the Mastercard. Instead she told me that unless I was willing to file and identity theft case with the local police department, the entries would remain on my credit bureau file for another seven years and there's nothing I can do about it. SOOOOOOOOOO I filed a complaint with the federal trade commission, the attorney general's office, and the better business bureau today AND filed a police report last night. The officer who took the report said "Hmm I don't see evidence of identity theft, but I do see evidence of fraud." Guess who the charges are against????????? MIDLAND! Yay! Not that this will go anywhere at all, but it's just another small victory, the way I look at it. I've taken days off work and I always pay my bills. To have my credit ruined by these jokers is criminal and it's time someone put a stop to it. So hopefully this case filed locally will be forwarded to the right authorities elsewhere and a REAL fraud case brought up for Midland. They deserve it, after what they've done to literally thousands of people nationwide.
If anyone else out there has had this happen to them, I'd like to hear about it, as I'm creating a list of names for a future class action lawsuit. Last year I applied for a loan to put a new roof on my house after it was damaged in a storm and was denied. I also had an opportunity to work for a prestigious firm, but was not hired because of my low credit rating. I've worked all of my life (I'm 52) and now these scumbags have me living without the necessities for the well being of my family home. I hope they all rot in jail (although I know that won't happen). Whew, sorry to write a book...but to those out there with the smug attitude that because they are a business reporting to the credit bureaus, they must be in the right, you are naive and stupid. There are bona fide crooks in credit collection and I hope you never have an opportunity to have them ruin your life like they have mine and thousands of others.

Wow, stories like this just really upset me. I hate to hear it when these companies just run roughshod over people with complete disregard for humanity or the law. It disgusts me that they seem to get away with it for so long, after damaging numerous innocent lives over false allegations...
