received Alias summons -- confused as to what to do next

Hi,
new here as I was researching Alias Summons info. I live in cook county in Illinois.

I got this summons this weekend. Here is the info:

Return date of 3/24/09. My debit is 2200.00 that was a credit card debt from Capital One. It it now with North Star Aquistion.

I don't remember the last time I paid on this credit card. They have a charge off date of 2/05 listed on the summons.

Should I call the attorney that represents this agency ? I looked up apperance froms on Cook County website, but do I fill it out and pay the fee before the return date and still show up on the return date? Is that an actual court date?

Is it basically too late to do anything? I am now scared more credit card companies will start suing me and garnish my wages.

I am scared and don't know what to do. I did stop paying my credit cards when I lost my job a few years ago.

Same thing happened to me last month with an old Capital One debt. Seems like they are doing this a lot lately no matter what amount the debt is.

I would suggest you call the attorney who is representing them and try and work out a payment plan. That is what I did. ONLY agree to pay what you can afford. If for some reason they don't with a payment plan you can afford and it goes to court don't worry. Just tell the judge what you can afford to pay and they will order a payment that is affordable for you. They can only garnish wages or bank accounts if you default on a payment and win a judgement against you. I know it must seem stressful but trust me, its not a big deal.

ok thank you .. I did call them the attorneys but they didnt want to give me anything in writing for a one time lower payment, they offered to knock off 600.00.

Then they asked for my employer info which I was afraid to give them so they said they can't help me.

Was that bad? Do I fill out the apperance form before the return date or just show up at the return date?

You made the right choice by not giving your employer info. The law office I am dealing with right now asked for mine as well and I told them I was unemployed. It's none of their business!

I'm not sure how to answer your question about the summons. I didn't recieve a summons, just a notice that I was to appear in court. Which I am probably going to have to show up anyway since they still have yet to send me the payment agreement for me to sign and send back. I don't see that happening before my court date. Unfortunately, i was not as smart, i gave the collection agency for capital one my bank info and work info because they were going to settle with me. Well, their settlement was several hundred dollars more than the summons stated. They cannot touch my bank account until i go to court to fight this, can they? I don't think i owe that much, bu i don't know how to fnd out
