I was also contacted by Taylor James and Associates today. I called back and asked what it was in regards to. I didn't get the man who called me and left the message but the man I spoke with gave me info regarding pay day loan I had taken out. I had questions for him but kept insisting he could not give legal advise over the phone. Some of the same things happened to me on the call that happened to others who where contacted by them. I was wondering, should I contact a lawyer tomorrow?

Hi Eric,

Welcome to the forums.

Be aware of all the names used by this company when they call consumers for collections. Sometimes, they will identify themselves as Ellis Crosby and perhaps, they are recently working under the name Anthony Galloway and Associates. All these names refer to the shady collections made by them.

Learn about your consumer rights laid down in the FDCPA before making any deal with them. Ask them to validate the debt first as it is your legal right to know the details of the accounts.

You can always take legal counseling for your comfort. Send a cease and desist letter to the company and mention that all further correspondences should be made only through mail and with your lawyer. This will keep them in the best of their behavior.

Roxette,
Thank you for your reply. As this was not the only one of these loans I had out, I was weighing the decision of whether to file Chapter 13 or maybe to go through consolidation of some sorts. I don't want to lose what little I have(which isn't much) and was rather frightened by this call. Can I write them the cease and desist letter without call them back? And also, how are they able to get away with using different names?

Talk to your lenders and see if you can make payment arrangements with them. Tell them that you were contacted by this company and you have heard them to be running under different names. I assume the lenders will understand your willingness to pay the debt and will therefore work on your account.

Yes, you can.

A company that is doing illegal business does not consider the legal formalities. They are preying on the innocent consumers and doing fraudulent activities. Read some of the posts in this forum on this company. You will realize the different types of tactics used by them.

You should be willing to complain about the harassments done to you at the FTC, BBB and the state attorney general as well.
