BOA/FIA trying to double collect
Date: Wed, 03/04/2009 - 18:45
Anyway first I was getting letters from FIA for payment. Then it went to Creditors Interchange for a few months all with the same account number as my original BOA account.
In Dec it went to Nelson Watson but had a different account number, still 16 digits but totally different. But due to the balance I knew it was the "same" account as I only had one BOA card with such a high balance. Anyway, I worked out a settlement with Nelson Watson on this account at the end of Jan. Feb they got my first of 6 monthly payments. This Friday is supposed to the be the 2nd payment.
Well today I get in the mail a dunning letter from a local collection law firm wanting to collect on the same $12,831.39 FIA account, but with the original account number from BOA!
I called Nelson Watson right away when I opened the dunning letter today. They seemed to be helpful. First they told me they were moving the payment date to next Friday. Then they would look into it to verify they should keep collecting on it. They also must have on file the original 16 digit account number because when I told it to him he knew it was the same as the new account number. In other words both 16 digit account numbers are in his system for this one account.
Hopefully it is a records mix up with FIA card services since they changed the account number at some point. It will not be good if I've worked out a settlement and paid money to Nelson Watson already and FIA tries to turn around and collect the full amount with this law firm.
Has anyone had this happen to them before? Work out a settlement with one CA then have the creditor try to collect the full amount with another CA?

Hi Arb,
It seems fishy to me. How on earth could the account number change? Did you send a debt validation letter to Nelson Watson before coming to a settlement arrangement with them?

I was still in a debt settlement pgm at the time they sent the dunning letter. I don't think the settlement pgm was very aggressive with sending DV letters. So no, I did not. I've since ended the debt settlement pgm to save the fees and because I felt I could do as good or better with the settlements now that I'm more familiar with this whole process (much thanks to this site on that one).
I have another smaller account that was BOA and became FIA and most recently I'm being contacted by Brachfeld & Associates. That account number has changed twice from the original BOA credit card number! Once when FIA was still contacting me directly and again now that it is with Brachfeld. I have sent the DV to Brachfeld on that one.
