Police says i should call State Consumer Affairs before I file a report. Telemarketing job doesn't require much skills do they? not even patience.
Has this happened to anyone else?? I suggest you do the same thing, call State Consumer affairs

Request the police for an affidavit so that you can send it to the consumer protection office. This way, the legal process will be much faster.

Thanks, he already left. Sallie May's Supervisor/Manager, ERIC says hes gonna look into it.
I checked her number, (702) area code is in NV. Im pressing charges no matter what happens. I just hope everyone else who's been getting calls from (702) does the same thing. I have her real name and address, i can't post it here

Dear HarassedbySallie,
If this person is calling you about a defaulted bill from HER OWN CELL PHONE she's friggin' nuts!
Like I said before, I never worked for them, don't vouch for them, and this business of calling you after hours on her own cell phone is just plain creepy!
To be perfectly honest, speaking on my own behalf, after a long day at work, spending hours on the phone with people who are generally argumentative, I just don't want to be on the phone at all after hours! I could easily take a vow of silence when I'm not at work! Just like, if your full time job is to bake bread you don't want to bake friggin bread at home!

unbelievable. be sure to follow up on this. although it would be hard to prove in court, and the agency isn't responsible for what an employee does on their own phone, it still isn't right. if you can afford the time and energy, you should pursue this as far as possible.
ooooooooooooooops!
Sorry, fingers slipped!
As I was saying, I'm not even going to try to understand or figure out this wierdo! What a flake!

This rep was from Sallie May Com. at first she called from Sallie Mae's phone number. I told her to stop calling, i already filed Cease and Desist letter. Stop calling and she was about to say something i hung up
she then called on her own cell phone, (she doesn't even have caller ID Blocked) and started to curse, i said "im gonna record your calls and press charges if you call again", she called and hung up and called, and hung up, for the rest of the nite, she tried to call from another 702 area code.
I called Sallie Mae about their rep, manager says he'll look into it,
I then called the police, they said to file State Consumer Affairs, gonna call them on MON and get that affidavit first

702 is a Nevada area code.
Don't let your guard up yet, it's been my experience that the phrase "I'll look into it" is code word for "I really don't care, just telling you what you want to hear so I can end this conversation quickly" I could be wrong in this case, but after a period of time, run-around gets more decodable.

If you file a complaint with the harrassment agency in question youre wasting your time. They wont help you because they might not get their commision - even if you dont owe money.

I don't understand...is this person working for Sallie Mae in collections? Did you default on a bill? Or are they just calling you as a telemarketer?
Either way, that is soooooo creepy and I would definitely follow the same path you are with calling the police and such. If you know her name or information, I would look into filing a restraining order. This doesn't sound like a collection call, more like harassment..........weird.

I wouldn't call it harassment since she's not doing it from the office. If it's from her personal cell phone it's more like stalking.

We need to be very careful when we use the term 'Harassment' and file a case against collection agencies on such charges. If the charges do not fall under 'harassment' category as per the books of law, we might suffer a setback.
Some things commonly done by the CAs do not define harassment. Read articles perhaps, in some federal websites and know the actual meaning of this term. If the collection agencies are harassing you for invalid, inaccurate or outdated debts that do not belong to you, you have the rights to file charges and dispute them under the fdcpa.

David,
I mean something more like personal harassment, not necessarily a charge of harassment against the company. If this freaky person is taking a number home and calling from her cell phone or whatever, I think that is just weird! I would definitely contact law enforcement on that one. Just my opinion though :)

Mary, I completely agree with you here. No collection agency
Mary,
I completely agree with you here. No collection agency should make a personal remark while collecting the debt. Also, they should not threaten with legal actions verbally unless they intend to do so. In case, there is a need to file a legal case, a formal letter must be sent first mentioning that the account has been in default and all collection measures have failed thereby leading to legal actions.
Debt collections should be based entirely on a professional approach and there should be no personal touch in it. If a collector is going out of the legal lines, he must face our attorney at the court.
If you can take this to an attorney that deals with these types
If you can take this to an attorney that deals with these types of things, he could subpoena her cell phone bill and your phone bill....and there is your proof right there, simple. You have a case, if you don't give up on it.

At first Salle May Called me all day and night. Then one day i finally picked up the phone and I told this individual to take me off the list, i have all the calls from SM recorded. (yea i cursed her out).
This individual telemarketer called me back! on her regular cell phone! luckily i got her home number and name on my Caller ID. She hasnt called me back since then.
I also told them to take my name off the list, i already sent a cease and desist letter that they signed. So far none of them called me back...yet

Hi HarassedBySallie,
That is horrible that she would call you back on her cell phone...how unprofessional!!!! But it sounds like you have been able to calm the situation with the cease and desist letter...isn't that a great tool? :)
I hope things continue to go smoothly in this situation for you!
