I need help STAT!

I am a MN resident I took out a payday loan from Cash Advance USA located in Florida on 11/2007 of 200.00. I made 10 ($50 payments)


Then I closed my account because they were telling me that these were only renewal fee's. They were taking random non approved amounts out of my account.

They have now turned my acoount over to Capital Collections in Florida. Capital Collections is rude, calls me at work, they hang up yell at me and tell me that they will file a law suit. They ignored the BBB complain and the AG complaint that I filed. Which both compaines were of no help. I filed a FTC complain but have heard nothing so far. They are telling me that if I dont pay them tomorrow by a western union order that they will file a law suit and I will end up paying thousands. I am very scared. They refuse to send me any of my account information or proof that they are legal to lend, or collect I sent a certified letter to them a month ago but they ignored my request at well.

Help I need immediate help i only have until March 6 5 PM> or they will do this.


My guess is this is an illegal payday loan company using an illegal CA to collect a debt. First of all dont panic, debt is a civil matter not criminal and I doubt this CA is going to do anything to you other than threaten and harass. Legal legitimate Collection Agencies do not behave the way this company is. Have you sent them or asked for debt validation? Have you checked the licensee data base of your state to see if they are even licensed to Collect in your state? If they get you on the phone again tell them you want Debt Validation and their license number to collect in your state and then tell them you are recording their call to turn over to your AG's office and the FTC. I bet they will hang up faster than you will know there is no one on the other line.

i sent them a debt validation letter by certified mail they called me and told me they dont have to follow the collection agency rules since they are a law firm however they are called Capital Collections. They also told me that due to time restraints on this account they need to move forward and I need to quit comming up with reasons to stall hence they wont be sending me information.

I have never recevied a letter from them only phone calls...They claim they sent me a letter back in July which I have not moved in 8 years so that letter never made it to me. If there was such a letter it should be easy for them to produce a copy of that letter to send me again right?


They called my place of work today 5 times yelling at whoever answered. I asked them not to call they immediately called back all 5 times and I hung up. They have already been sent a do not call request by certified mail however this has not made its way to them yet. I would fax it as well but I dont want them to have my work fax number. My supervisor notified security they are considering pressing charges if they Capital Corporation doesnt comply to my request . They threatened that they would come and arrest me at work for fraud and fax all of my loan documents to the local police dept and have me arrested and criminal charges pressed for fraud along with hefty fines.

my thoughts are what happens if they can do something? and seriously this is over a 200 loan that I have clearly overpaid on. they decline to send me any further info. tell me that I am stalling on paying by doing this. what else can i do short of hiring a lawyer? which i dont want to do but dont know what else to do.

I am supposed to make my first payment tomorrow. They called to get my human resource fax number last week and faxed them a wage garnishment sheet. My work already received a request from them to garnish wages how does that work? I did call payroll and talk with them they said generally that sheet is all that they need I have a hard time with this since I work for a large employeer that this is true? I told my payroll dept about the situation they are going to check with the legal dept at my work to see what they should be doing. Shouldn't we have to go to court for them to do this or something? I feel like I should cave and pay them I would be much more ok with paying the original company instead of the collection agency/law firm. Hoenstly i think the collection agency has the same people working that the loan place did. Phone numbers are just a few digits different and everyone has a heavy accent all sound the same the alleged lawyer didnt even give his name declined said all that i needed to know was that he was a lawyer and since he was a lawyer he can call me at work even though I requested for them not to. crap!

Very simple, what they probably sent to your employer is a "Wage Assignment", usually, payday lenders hide that little phrase in small print when you sign up for a loan. All you need to do is send them an email NOW, and say the following:

I hereby revoke any and all wage assignments I signed with (insert name of company), I have notified my employer so any wage assignments you may have sent to my company will not be honored, per Federal law.
Your Signature.
Now, print out this email, and take it to your employer asap!

to the guest two spots above.if your HR allows that wothout a court order.go to th big boss and inform him.without a court order they do not have to and should not accept that.garnishment takes a court order.i would also go to NACA.NET and find a consumer attorney and look into legal action against this bottomfeeder collector.that is what they are pure and simple,but push the point that it is not a granishment because it is not court ordered.no court ordered garnishment would come via fax.it would be sent by the court in the mail.

also they are the ones declinig to provide information so honestly how can i be the bad guy if they would simply comply to my request I would be happy to pay up if they prove that I rightfully owe after a account ledger, proof of licensure, proof to collect, is sent to me

You need to call your state Department of Financial Institutions tomorrow and ask about this so called Collection Agency/Law Firm. I do not see you going anywhere over this, legitimate companies do not act like this. It is your right to have your debt validated. Personally, you need to stop talking to these clowns all they are doing is upsetting you.

Capital Collections called me at my work on 3/6 I immediately transferred the call to our security office as soon as Security answered Capital Collections hung up. They however called my cell phone and left a nasty message about how they are going to call me daily until I pay they even swore and said that my "damn" attitude needs to stop and they are finding my tone of voice to be annoying on my answering machine! I am switching cell phone numbers and my employeer is filing a harassment complaint against them if they call me at work again. I have already sent them a cease to communicate with me request by certified mail along with a second request for a debt validation. I filed complaints with MN AG office, FL AG office, BBB in Florida and MN. I also faxed my inofrmation to the FLorida Bar Association since these clowns claim to be attorneys/lawyers but are not on the registry as such! These folks are going down!
