garnishment

creditcard companies have wnet to court and filed judgement and have now garnish my checking account i only have income of disibilty retirement .... is this legal?


Social security benefits can never be garnished for recovery of credit card debts. However, it can be garnished for outstanding Federal Tax debt and alimony and child support obligations. To be sure that the creditor cannot garnish your bank account, you need to inform the bank in writing that the amount that gets deposited in your checking account is your disability benefit.

Actually, in some states and in some circumstances bennies CAN be garnished for consumer debts. There really is a lot of what-ifs-and-whys about it though..I remember having training about it a few years back, and have an insert in my HR manual at work about it! Never seen it actually happen, though.
