filing an answer to summons late
Date: Sat, 03/07/2009 - 22:12
I got down to the courthouse on Friday only to find out i needed to have another form filled out by a 3rd party not involved in the case, a declaration of service. It was too late to get that done and it was the 30th day since I was served the summons. The clerk said I could come back on monday and file the papers. She said they normally don't file a default that quickly and it wasn't possible to do before 2pm on monday anyway. does it even matter? Can I file the papers late, 1 working day, if they haven't files for a default judgement? can the creditors turn around and say I filed the answer late and still get the default?
any ideas? should i file and pay $200 if I am in default all ready?
i filed at the last minute because I am working with law firm in a debt resolution program and they were extremely late in giving me help on this matter.

You should first try to file an answer to the summon by visiting
You should first try to file an answer to the summon by visiting the court on Monday. If you somehow manage to file an answer, there cannot be a default judgment against you and you will get a court date to defend yourself. After filing an answer to the summon you can ask for debt validation from the creditor.
