I am hoping someone can help me. I just ran a free credit report and found two civil claim judgments on my report from MRC Receivables Corp. One was filed on 9/12/2005 in Dakota County Conciliation Court in Apple Valley, MN for $1,572 and the other was filed on 9/13/2005 in Dakota County Court in Hastings, MN for $2,100. I never received any notification by mail so of course never went to court. How do I find out what these are for? I tried to look up MRC Receivables Corp to get a telephone number and cannot find one. Thank you so much for your assistance.


Have you called the county clerk in these counties? They should be able to tell you. You can also file a motion to dismiss based on imporper service. The forms should be on the counties website. Or the clerk of courts should be able to help you find those forms.

I take it you don't live in MN?

a question--do you live in that county? Or did you ever?

For debt collection, they can only sue you either where you currently live, or in the county where the debt was originated. If you never lived there, then they pulled a fast one on you by filing the complaint in the improper venue. Improper venue and improper service are both grounds to have the judgments vacated.

Contact the court clerk's office in that county ASAP. They should be able to get you the whole docket for this case, so you can see what was claimed about how they supposedly served the summons. The proper procedure is usually to file an order to show cause with the court, and request that the judgments be vacated due to improper service(and also due to improper venue if you never lived in that county). Bear in mind though--this is not a way to get rid of the case entirely. If the court sets aside the judgment, the plaintiff is free to refile the case and try to get it right this time. But it is still very important to do this because these judgments could be fraudulent, and in such cases they wont have proper documentation to prove that you owe them. Thats why they sneak around about it.
