Hello,

I need to know if anyone has heard of A S & Associates. I received a call from this lady at 866-331-6161 claiming to be an investigator with a particular county and I needed to call back concerning a legal matter. I called her back to find out she was calling me concerning the payday loan I defaulted on. I went through a horrible divorce and and I'm a single mom trying to get back on my feet. I explained to her my situation and am willing to set up some kind of payment arrangement. I was threatened if I couldn't come up with at least 50% of the money owed I would most likely get arrested or possibly probation. If anyone knows anything about them please let me know. Thanks!

Yup they are a nasty CA very similar to Elis Crosby, meybe even former employees.

They called my old Mom and my cousin and scared them to shit that I was in big criminal trouble.

My dear, there is no such thing as debtor's prison. We do not live in the 18th century. Postdated checks used to get loans are not bad checks either. A bad check is a check that violates COD, Cash on Delivery. It's not like you are receiving a merchandise and you fail to pay for it on delivery.

So don't you worry at all and read this forum and educate and arm yourself for dealing with these predators.

Hi Klp

Welcome to the forums.

As said by Kam, there is nothing to worry as long as you are willing to follow the rules put in the fdcpa. Before you send any money to the agency, the debt collector must send you in writing about the details of the accounts through complete debt validation. You can refuse to make payment until your debt is accurately presented.

Be careful while dealing with this collection agency. Do not make any payment agreement and update your contact information until they have sent you the correct details. They need to first prove that they are contacting the right person with the correct SSN# and with the right account.

More information on this company is available in the thread given below.

Thank you so much for the reply. I do feel better. They had me in tears last night over this. I will follow through with fdcpa rules and continue the process. Again, thanks so much for the help!

klp, the fdcps laws are not for YOU to follow, they are for the collection agency to follow. while they shouldn't be threatening you with jail, it is in your best interest to cooperate with the agency. if they are demanding 50% then you should do everything you can to come up with the funds. if you fall short, you should contact them asap and let them know how much you are willing to put down as a good faith gesture.

Maria, don't feel scared. The collectors do that kind of illegal threats so that people like you get scared and send them money without verifying it and without any documentation. Did you ask for a debt validation? Stick to your ground and say that you won't send any money until they have validated the debt and you have reviewed it. You will feel better after reading the FDCPA laws. Use this as your legal weapon when you get the collector's call next time. Trust me, nothing is going to happen as long as you are aware of your legal rights and the collector is not acting according to the federal laws.

I received a call from Greg Patton today as he is threating me with 2 counts of criminal acts. One for a bad check and one for fraud. I asked him to send me somethingin writing he told me that he did not care if I paid 1 cent on the account he was going to have me served and prosecuted tomorrow. I am a little scared but not completly because I know that they are just trying to scare me. He then called my work and talked to my supervisor and told her that he wanted to have me served with papers. She however told him that it was a personal matter and that he would have to discuss it with me only.Any suggestions would be greatly appreciated.

AHHHHHHHHHH the famous Greg Patton..........he tried the same thing on me. Told me the exact same thing he told you........although he did finally fax me over an invalid account balance on a pdl I got from National Money Store. Good for your supervisor telling him that.......I sent them a Ceast and Desist letter to them and I also filed complaints with the TX AG.

What happened after you filed complaints and sent them a cease and desist letter? Anything? I had a Henry Jay contact me from there, and sent them c&d and dv letter certified back in April and have received any calls or correspondence since then. I filed with the BBB, DFI, and FTC, and nothing back from those agencies either.

I recieved a call from a person at A & S Associates while at work today. Based on the comments by those in this forum, I faxed them a request for validation. Within 10 minutes I had a call from a different person there asking me to call back at my "earliest" convience. I then sent them a C&D for contacting me at my place of business by phone, fax, mail or in person.

My next step is to let them know that I will only deal with the original creditor.

I too got a call from Mr. Patton. He told me, even though he didn't know he was talking to "me" that he had 6 or 7 counts (he didn't know which) of check fraud against me. Didn't tell me who he was collecting for just that the District Attorney was filing charges. I asked him where he was, he told me Houston. Then I asked where the charges were going to be filed, he said whatever county I was in. I read earlier in this thread that NMS uses them, so at least I know where to start. I do owe NMS, so I will have to deal with them.
My question is this--do I send C&D and DVL to them? I would like more info from Patton, but I really don't want to call him back.
At least I know NMS reads their e-mail!
I also got sent to collections by FTR Processing & EME Marketing. Any info on them? Are they MTE by any chance?

I have had the displeasure of having to deal with this company. I received a phone call from someone who identified herself as "Karen" and an investigator. The operator nosey as she is, asked Karen if she was investigating me. Karen then asked to speak to the Human Resource Dept. where she asked personal information about me including the amount of my paycheck. And asked to speak to my boss. I was humiliated that day. My boss just happened to be standing in my office but did not take the call. This woman was rude and actually told me that I should "Pawn" something in order to pay this debt and additionally told me that she was going to turn my folder over to the County. I did some research on the internet and learned what my rights were and faxed a letter to this company advising them not to contact me at work.

Thanks so much you guys! I got a call today and the lady was so rude when I attempted to admit my guilt. She request 50% like you guys stated and I told her I couldn't. After reading this, I called back requestin complete debt validation in reguard to what I owed. She has not responded yet. When she does, I know the course of action to take as listed in the fdcpa.
Thanks a million you guys!

Rest assured bbiniak. You will not be arrested as debts are civil matters, not criminal. The only thing this agent has succeeded in is violating the Fair Debt Collection Practices Act by stating that you have committed a crime or that you will be arrested. Which you can actually file suit for $1,000 for.

Additionally I would suggest sending them a debt validation letter (you can find a good template via my signature link, be sure to send the enclosure with it) send the letter certified mail, return receipt requested. Once they receive it they must cease all collection activity until they provide you with validation.

I got a call last week regarding a PDL, that I received from Greg Patterson, stating the same thing go to jail, got a PDL online while I was at work, etc.... I ignored it, then Lisa Taylor called and left a message she call me by all my legal and divorce last name plus my auto liscense plate #, I said to myself OMG. I called her back and of course silly me stated she had the right SS# and I banked at that particular bank, stated I owe 1,030.00 and how was i going to pay, before she go to court and turn me in. OK I am real scared now! She want 50% I do not have that I agreed to W. Union $200 tomorrow, If not by 12:00 she will turn me in to the courts and i will get embarrassed and picked up all of these things, Do I have to send the money? What will happen, I don't need them to call my job. and I am sure they read this website also and place their comments. You think?

I have been receiving calls just like the rest of you from this irritating little man but i am having on huge problem with him. I made a payment arrangement with him before i read the forums on the company so i closed the card immediately. I called him today and i let him know that i did my research on his company and he blew up at me! i told him that i want to deal with my creditors on my own and that i will get a lawyer if need be and he simply went bolistic. My problem now is i can not find out where this loan is from. I never received any calls from the company before he started calling me and though i think i know which one it is i cant find any contact information online for fast cash. What would my next step be? He says he will send a summons to my work and he has already called them, my friends and my father telling them i was in trouble with the law due to an unpaid debt. What now?

I got a call from someone over at AS&S Associates. I defaulted ( and by defaulted I mean blocked them from charging my account since I'm from NY) on a VIP loan and the account is now with AS & S. I called VIP after i spoke to this woman and they said it's out of their hands and I can only deal with AS & S.

My original loan was for 400. Now AS & S says I have to pay them 959 dollars right away or they are sending my account to court.

They didnt even give me an option to settle the account in payments. I have no idea what I can do now. Suggestions?

they won't send anything to court.next time they call.tell them you will not speak to them until they send something.two points.

1)internet loans don't go by checks,so they are full of it.
2)if your loan was for 400.00,and they debited anything it goes toward the 400.00 as pdl's are prohibited in NY.

all they will do is call and threaten.don't speak to them again.instead file an AG complaint against both the pdl,and the collector.

this same company told my sister that there would be a warrant for her arrest tomorrow if she did not send them $832.00. however her original loan was $300.00. Does anyone know how the amount could have increased so much and if it is possible for them to have a warrant issued when our local authorities are not showing a warrant.

No she cannot be arrested. Depending on who the company is and what state she is in, either the payday loan or company she got it from could be illegal. Most of the time all people have to do is pay back the principle.

Tell her not to worry, if they call again, ignore them. Turn them over to the Attorney Generals office.

Irispat is right, your sister can't be arrested for not paying a debt.

Regarding the amount that these collectors are charging.... you must tell her to send them a debt validation letter. You can also use the sample letter from this site. And yeah, don't forget to send the DV with a return receipt request and preserve the receipt for future references.

Someone named robin carter of a&a associates called my girlfriend house looking for me. She left a threatening message on her voice mail, as my friend did not pick up the phone. She left this number 866 331 6161. Did you know that these payday loan companies are being banned in most states from lending money? Do your research, i did. I live in ny and they are not legal here. Alot of these companies don't even have licenses. Stand your ground, do research, never send money to anyone! It is all scare tactic. File complaints as many as possible. Maybe with all of us sticking together we can do something.

I got called from Diane Roberts and claiming that I owed way over the amount of money I owed and only owed them 100.00 principal and 50.00 and I defaulted in February when my bank account was froze due to unauthorized charges coming through and then they asked me to pay 100.00 on April 3 and I gave them my card number to debit from VIP cash so I didn't owe anything to them.
I filed a complaint with the FBI and local authorities about this

Just deal with the company you own the money to...do not even call them back..they are rude, nasty use bad language and are garbage people....

I had already called the company i owned money and they were already taking payments out months ago...

They should not be calling you at work and using foul language..just slame the phone in their faces, block the line with your phone company and arrange payment with your company that you have the debt with....

Threats are no no ass associates!
