I just received a letter from 3rd party collection agency. I am in Arizona and they are a licensed collection agency in Arizona. They are SMith, Haynes, & Watson, LLC.

I took out two loans with Eastside lenders. One was for $300 and I paid $975 on it, done - PIF. The 2nd one was for $600 and I paid $540 before I found out they were illegal. I notified them of the ACH revocation, but they continue to try and withdraw $. I told them I wasn't paying the remaining $60 on this latest loan as I had overpaid $675 on the prior illegal loan.

They are claiming the whole Deleware license crap, but according to Arizona they don't have an AZ license.

I know I need to send a debt verification letter to the collection agency, but my main question is, do I send the collection agency a copy of the ACH revocation letter explaining that Eastside Lenders is illegal in Arizona, etc. Or just use the basic form?

I have never sent out a debt verification letter before and just want to make sure I do everything right.

Oh yeah, the collection letter states that they are asking for $1,343.30


I put mine on the C&D letter. but I dont think it would hurt to put it on both if thats what you want to do. You may also want to ask them to provide you with ESL's License# to lend to AZ residents. Also, refer them to the AZ Department of Financial Institutions for verification that AZ requires internet based lenders to be licensed in our state.
