Storefront PDL

I had 1 storefront PDL that defaulted over the weekend. I contacted them, of course not in time to break it up into 4 payments.

I looked and they are following the law within Minnesota and are licensed.

The guy was a total jerk and said it would have to be paid in a couple of weeks or they would pursue criminal charges for a passing a bad check and I would go to jail.

I don't think I can go to jail for bad check because at the time of the check it was good.

They also refused to work with a debt management company.

Any suggestions. I can try and pay them over the next couple of weeks I suppose.


legal storefronts can pursue legal action so if it were me, i would personally make it a priority to pay them back. i am sorry the guy was a jerk, i am sure someone else would be around to help but i am sure there is someone else that would be able to discuss this with you within the storefront? do they have a centralized office? which storefront is it?

That is what I said to him. He said no by code blah blah blah, passing a bad check in Minnesota is a criminal act. I forwarded the information to the debt management place and will see what they have to say. I said to him, well then I will file bankruptcy and he said "I cant" this wouldn't be applied. I know 100 percent for fact that it would. I do plan on contacting the attorney generals office to let them know he is threatening me and refusing to make any arrangement at all.

OK.

1. He is incorrect about passing a bad check. You cannot be prosecuted.

2. On your contract, there was probably a statement where you stated that you have not or were not planning on filing BK. Almost all agreements have it, but there is not much in the way of teeth to it.

3. Atty Gen will take the complaint and investigate. You are better off to file with DFI.

4. Atty Gen will not force them to accept payments since the agreement stated that you would pay back in one lump sum. They will highly suggest it though and it is in the best interest for the PDL to make thise arrangements very quickly!
