I recently had someone tell me that they paid off a bank in 2007 that was from 2002 so the bank updated it and now instead of being removed in 2007 as he should have been, he is going to remain reported until 2012. Making a payment can cause the time in which you are reported to be prolonged.
ALso, they must report accurate information or they must remove. If they are showing an incorrect amount that you do not currently owe, then I would dispute it and ask for removal on that basis. They are reporting inaccurate information on your credit report.
Chexsystems allows the vague " FRAUD" "NSF" and "ABUSE" flags because they are harder to dispute and remove. There are no clear standards for what is considered NSF, Fraud or ABUSE. They can mean anything a bank wants them to.

Again, you are looking for any type of inaccuracy you can hold them accountable for. The FCRA specifies that only accurate information can be reported.
Another avenue to go if you can???t get your item removed. Being listed in Chexsystems SEVERELY (if not completely) restricts your banking abilities. They can be held liable for multiple FCRA violations if the information they have on you is not correct..the information must be 100% correct.

Wouldn't that still be covered under the FCRA? I know Chex and the like use a 5 year reporting period vs the 7.5 years but the DOFD wouldn't change.

I'm hoping BOFA plays nice when I pay them next month, what I ligitmatly know. (Yes it went to a collection agency, but I disputed the amount since I knew exactly how much, I also am not paying said collection agency but BOFA directly) I was advisded that they will delete the information once they receive the payment, but it could take up to 30 days. So we'll see. Two people have told me this, if it doesn't ii'm willing to fight. MCA knows what a hassle I've had with one of my credit unions reporting incorrect information on Chexs (which is finally after a year of fighting complaining etc) has been taken care of. I did hire a lawyer and was in the process of giving him all the information when they finally decided to play nice, but didn't need it by the time they finally cleared things up.
I also wanted to add, that the correct amount owed was actually reported correctly on my credit reports.. just not on Chexsystems.. it showed almost double that actually it was doubled.

I would check your report in another month or so. BOFA said it could take up to a month to report. Depends on when they send their information over. Some do it at the end of the month (my old credit union) etc. But if it's not cleared up within a month, I'd be disputing it with Chexsystems.
