I received 2 letters from a CA dated Jan 12, 2009, giving me 30 days to respond / dispute for 2 old Cingular Wireless accounts. I sent off a DV letter via certified mail, return receipt requested on Jan 26, 2009. I received the return receipt on Feb 2, 2009 signed.

On Feb 16, 2009 they posted a "UNPAID" for one of the debts to my credit report (with a status date of Feb 1, 2009).

Now, this may have been my mistake - rolling up the DV letter to include both debts since they were both with the same CA and creditor - although I did state both accounts in the DV letter and that I would like a response for both debts.

So, my questions now are...

1) Was it valid for them to hit my credit report before the 30 days they had given me?

2) Since it has now been over 30 days from the date they received my DV letter and I have not heard anything back, how do I now proceed?

Thanks in advance!

go to NACA.NET you will find a consumer attorney that will sue them for FDCPA violations.that is considered continued collection activity after a DV letter was received.time to take action here.that is worth 1,000.00 for the FDCPA violation.also 5,000.00 for the reporting a disputed debt on your CR.
