I was in collections with UCB for an outstanding debt of 11,000. They offered to settle for $5000. I sent them a validation letter and they never responded.

Now it is with another CA and they just called offering me a settlement of $9000 so we're going in the wrong direction obviously and they were bringing my husband into the picture. He's not on any of my cards and they want me to disclose his information. I told them I would not.

Do they have any right to ask for that? They seem very pushy about that. I told them it's not his debt and he's not listed as a card holder and they say he's still liable? Is this true?

that is a bottomfeeder for you.send out another DV letter to this CA.

I never disclose any information to a CA. The only thing they need to know is if you are requesting validation, disputing the debt or agreeing to pay with set terms. All personal information does not pertain to the collection of that debt including items like your social security number, current income, own/rent, tax returns, spouse???s financial information and so on. Frankly, if it is a legitimate debt then they should know most of that information already. If they don???t have it then I certainly would never provide it to them and I would consider their call a scam.

The issue still stands on if you are in a community property state AND if the debt in question was incurred while you were married. Then there is the issue if your husband ever knew about it...there are remedies for such situations, but it will be spelled out in your state's law.

However...if the debt happened outside the marriage..then no matter what, your husband can't be held accountable. They will be sneaky though and try to hit anything with your name on it.

Goldenbast, I live in IL which I'm pretty sure is not a common law state but this particular account with citibank had been opened since I was 18. I'm in my thirties. My husband was not around when this account was charged up. We still have our accounts separate.

They are the first ones to be asking me about his financial info. It was with another CA previously that never responded to my validation request. Now they've handed it over to them.

I have no property, vehicles or anything with my name on it. No job right now as I'm trying to pass my state test for court reporting.
