I have an account with Portfolio Recovery that is past satute of limitations, they got it in 05, and I disputed it with Experian when I recently received a copy of my credit report, now all of a sudden they are calling me. It is out of the SOL period. What should I do? Do I talk to them and tell them they can't collect because of that or what? I want to know what I am talking about if I do confront them when I answer the next call.

thanks and PS... I am in Virginia

it's up to you,but if you choose to pay it make sure you get it in writing that they will mark it paid.if they refuse send a complete C&D letter.send it certified mail return receipt.as long as it is past the SOL they can't sue so again it is up to you.remember get it in writing.

but I am correct to tell her the SOL has expired, right? I haven't heard or received a thing from them since at least then, if ever. I don't even remember, thats how long its been.

Send them a DV letter asking that they prove the debt is your and that the SOL has not expired, stating what your state's SOL is.
They will probably tell you that the SOL laws were changed, don't apply, etc. But they haven't.

What state are you in and are you sure of the SOL?
