How many calls per hour is considered harrassment?

I have gotten 12 calls on my cell phone in the last hour from a creditor whom I already told them when I would be able to make my payment. I am offically as of tomorrow 30 days past due. They call and they also never leave messages.... I know I am late and I know that they want their money and they will go to the ends of time to get it, but if you make some kind of arrangement with them should they still be able to call you 12 times in an hour... and they day just started.............

if you are charged for incoming calls then they are breaking the law.send them a limited C&D letter stating not to call and to communicate by USPS only.they are not allowed to incure costs to you by there calls.the number of calls is harrasment anyway,but on a cell is not allowed if it makes you incure costs.

I don't get charged against my minutes unless I answer them right? They are well aware that it is a cell phone too.. I don't have a home number, since it is by far cheaper to have a cell phone now than a home phone now...
with that said, what can I do. I owe the money but they are relentlessly calling even though I made arrangements and havent had the time to break that arrangement because it is a week away.... it's my car payment...oops look 14 times they have called now.... and no messages yet. Thank Goodness for "silent mode" on my phone....

Question: if I send them a letter like you mentioned can they be jerks and want to get the car? They insist that have a phone number to call me at.....
I have a crappy payment history, but Im never more than 30-45 days past due... I am just a single mother trying to get by like everyone else...

By any chance is this company Nicholas Financial? I have a car loan through them and if I am even a day late they start blowing up my phone.

I don't really have much advice for you other than, I would just answer it every time they call and repeat the day you can pay. With it not being a collection agency and it's your car loan I don't believe you have too many rights.

I don't guess I have any rights with them either... I think I will just let them run up their phone bill trying to call me... I mean times are hard for alot of people around the country, you'd think they would be alittle more realistic. I guess that is the word I am thinking of... It isnt like I am 30(well I will be)but -60- or even 90 days past due, or it isnt like i haven't already made contact with them...

i would answer and ask them what the problem is. alot of places use an automatic dialer to call their accounts and the dialer is programed so when it reaches the amount of calls a state allows it will automatically block the account from being called. but if they are calling that much maybe there is somthing wrong? if not just reiterate what you told the last person. but i wouldnt send them a c&d just because c&d accounts go out for repo alot faster than a regular account.

your right it is an auto dialer, one of the numbers actually does not belong to them, and when you call it there is a message stating that this number has been used and contact your phone company to track the number blah blah ... Thanks for the C&D advice, I won't send it .. this company calls like this all the time, 5 or 6 times even if your one day late but not 20 times before lunch.. and NO messages. if it was that important I would have thought I would get the "please contact us before 2pm, or 5pm" line....

How can I find out how many calls a day my state allows? I am in NC.

Why not just answer it on the first attempt and remind them you made arrangements?? Maybe the person who setup the arrangement failed to document or code the account correctly.

They are not leaving messages because they want contact. And because they are the oc there is no law about them calling your cell phone.

Just wanted to update, that I finally spoke to someone and told them about my arrange ment and they "noted" my account but by the end of the evening I had a total of 34 calls from them, even after I spoke to someone "again". So is what everyone is telling that there is nothing I can do about the calls since it is the original creditor and not a CA and I can't really send a C&D since those kind of things are the first to go to Repo..... I just think 34 calls in one day is pretty ridiculous!!!!!!!!!!!!!!!!

Thanks for all and any further advice....I guess I will just keep doing what I can the best way can and hope that I can get back on track soon............................ =)

In the same boat. I got 50 calls to my cell today. I'm at work; phone on silent, etc. It's my car payment. I'm never 30 days late but I'm what's called a "slow pay". Companies track down to the penny on receivables and when they expect to get them especially in the current default economy. Of course one has to wonder how much they are spending to track down funds that are not even technically deliquent. I'll finally be caught up this month so the calls should stop but man what a pain.
