My wife got a call from her mom last night claiming that an attorney has called her and claimed that they are sueing my wife. She gave us the number to the attorney and we called him. He states that they have filed suit in Tarrant County( Ft. Worth, TX). Called Tarrant County this morning and they have a suit that they have been trying to serve since November. We have not lived at the address on file for 6 months. So now we are waiting on being served. What do we do now and how do we proceed? Midland is tring to collect for Household Bank is about 6 months from being out of SOL. Also, I am unemployed and we have no extra money to hire an attorney and we are about 3 months from being able to file bankruptcy. Thanks for the advice.

If you get sued, they can't garnish your wages in the state of Texas. Once you get served you will need to respond. Most of the time you have 20 days to respond. Don't ignore it. Do respond. It's ashame that you checked on it and gave them your correct address. You could have let it go until it was SOL.
