I'm Pregnant and this PAYDAY LOAN is taking almost all my money!!

I am 22 years old. I got a payday loan from HUSHHAWK Group (internet based) for $100. They have been taking $30 on the first and the 16th of every month now for MONTHS. I cannot seem to get them to stop. The loan has been WAY overpayed!! I am considering closing my account.

I also have a loan through CASHNETUSA.com for $300. That loan is due to come out on the 27th. I will not have the money to pay it. If my account is closed can I set up an arrangement with them? WIll I go to jail? I am pregnant and just want out of this mess.

Chances are you have paid the first one enough. First I would close your checking account. That is the only way to completely stop them from continuing to take money out of your account.

What state are you in? This will help us in letting you know if the companies are opperating illegally in your state. If they are illegal, then you are only required to pay back the amount that you borrowered. How long have you been paying on the loan with Cashnet?

The other thing. You will not go to jail!!! Debt is a civil matter and you do not go to jail for not paying a debt. These companies will threaten you with everything because of the whole bounced check thing. They are not allowed to even threaten such things.

Congratulations on expecting! Hang in there. I had a ton of pdls about 3 years ago and this site has alot of good people with alot of knowledge to help you get through it.

They deposited $100 to my checking account on 07-11-2009 and since have been removing $60 a a month! What can I do?? Someone PLEASE help!

I'm not familiar with Alabama laws but I guarantee there is someone else on this site that is.

But remember, don't let them harass you. Your health is much more important during this time. This should be a joyous time for you.

But number one, make sure you close your checking account. Also, send them a letter revoking all wage assignments and telling them to not contact you at work. Once they try to take the money out and they learn the accounts closed. They will definately start blowing up your phones. Thats when they really start to threaten.

Read the sticky about Closing your Account. You will need to verify with your bank that your account can't be "forced open" as has happened to some of the people on this list. Otherwise you will need to submit information to the bank specifically barring activity by the PayDay lender to protect yourself.

When I went to my bank they were very understanding about the problem and made sure to "hard close" the account to reject ANY activity after the date I closed it.

You won't be arrested. I am in Texas and I had a similar situation about 2 years ago - and I'm still walking around and not in jail or being sued. You need to talk to your bank manager and explain this situation. tell them that the loan is paid off, and you are still being debited, and the company won't stop. They will either close your account, or ask them to put it on a "total freeze" so no debits can come out of it. They CAN do this, and you woudl still be able to use your account, you would just have to deposit cash and go into the bank branch to withdraw it.

Honestly, the only thing that will happen if you do that (well, aside from the fact that you'll have more cash in your pocket) is that they will call you mercilessly with collection efforts. But in the end, there is little to nothing that they can do to you.

I forgot a couple of notes regarding your account - make sure you either put a hard freeze on it, or close it completely with a hard freeze so it cannot be forced open. Just attempting to block the transactions will not work, even if the bank manager suggests it. My understanding is that blocking a transaction blocks a specific "vendor number". The PDLs will go in under multiple vendor numbers (they all have tons of them) until they find one that isn't blocked, and they'll get their money that way. You need to make it clear to the bank person what is going on and that you cannot have ANY transactions on the account. Tell them there is a fraud if you have to (that's what I did to get mine closed).

Again, there is nothing they can do except call you and maybe harass a little, and you can ignore those, or send them "cease & desist" letters.

You do not send cease and desis letter to the original creditor, those are for collection agencies. I know some people have sent them after they start harrassing them but they usually don't work.

If you are dealing with the illegal payday loan company then you need to send a letter stating they are illegal. You can find that letter under the dealing with illegal lenders sticky at the top of the page.
