If this WNYC was actually a service processor, they would not care about anything other than getting you the summons and possibly a signature, not negotiating a settlement. Have them drop the docs off and then let;s go from there...

I recieved a call from a family member who indicated they got a call from my county court house claiming that they had a court summons for me. The family member was told that is about a loan and that they were on it. Mistakenly he called and found out that this was a scam. It is a collection agency and he wasn't involved.
I called the number and spoke to an individual, I asked who they were and they said they were WNYC, I first thought they were the radio station.
A day or so later I noticed on my phone messages that someone called. It was someone pretending to be a summons server from my county. He acted like he didn't know what he was doing. He never stated what process server he worked for. "I will be serving you, you should talk to (pause) there is a phone number 866-343-7209. Maybe you should call them and try to reduce the cost before it gets to court."
I called the number and the same guy answered WNYC. When pressed he indicated it is Western New York Capital. I asked for his license to collect a debt in my state. He didn't have one. "We are an investment company." The company is considered a debt collector in my state.
I am not afraid to turn this over to my States licensing agency.
I even called the court house in my county and they have nothing from them
I am actually excited to go to the court over this one, because the loan they are collecting on was never taken out by me. It was taken out by someone else in my name.
PS.PLEASE DON'T BELIEVE THIS COMPANY IS GOOD. LOOK AT WESTERN NEW YORK CAPITAL WEBSITE. THEY WRITE GOOD REVEIWS FOR THEMSELVES

The EXACT same thing happened to me... about 2 weeks ago. -The process server, supposed "fraud" charges, and the lady who asked for my debit card info after saying that CashnetUSA was going to charge me for "fraud". I just got off the phone with the bank, and they cancelled my card as being STOLEN. Thankfully no money has been taken out of my account yet.
The phone numbers they are using are: 866-511-6672 x111, and 866-511-9057. Some guy answers if you hit "0", and says it is an "investment firm".
They also continue to call and harass me and a family member, even AFTER I made arrangements to pay them (before I was onto them) calling my relative and threatening them that they would also get a "summons" unless they contacted me to get their name "off the case".
Plus they keep promising to email me something whenever I've asked for something in writing, but I have never gotten a single email. They also do not have a valid mailing address anywhere on their website, just an email address, and the lady asked for my email address, but since that day I've been getting a lot of spam in my inbox.
I also just filed a complaint with the FTC, they lady was very nice and said that what they are doing is ILLEGAL because they are making threats and did not provide anything in writing within 5 days of first contacting me. She also said that I can write them and tell them to stop calling, and once I do, they HAVE TO. She is going to email me some useful info about dealing with collections calls (not that these people are anything but scam artists), and also recommended that I get in touch with the credit bureaus in case these people also have my social security number, and file a FRAUD ALERT which is free for 90 days with TransUnion.

Cashnetusa Judgement summons
I had the same thing happen to me yesterday. A lady called me, my brother, my dad, and mom telling them they had documents for to sign, even hinted that they had document for 'them' to sign, being my relatives. The lady told my dad that "it is in the best interest that you have you son call us to get you out of this mess or it may implicate YOU!" Are you kiddin me? ! They threatened my father over a payday loan I took out in 2007. I fully intended on paying it back, called and tried to work something out, they wouldn't then either for less than $500 a payment. I was a student and wasn't making that every 2 weeks. Anyway, I don't know what to do considering I called and my $700 payday loan blew up into a $4,200 debt that they are supposedly taking me to court for. The guy I was called from even said he could work it out if I paid $1200 by the end of the month. I don't know what to believe. I live in Minnesota, and I said there has to be some sort of protection for consumers when it comes to interest and how far it can accumulate. Anyway, What should I do?!!

I want ALL of you know this place is full of BS. I have recorded conversations from these people, and I almost sued them, until the "president" of their company sent me an apology letter. My brother and I both received phone calls from this place (it was a different 800 number before we filed complaints both with the FTC and Wisconsin Department of Financial Institution) The FTC had me file in my state because they called me here, eventhough the company is located in NY. By the way it was a similar case, they were threatening to take ME to court for a loan MY BROTHER had taken out, and they were trying to take my older brother and I to court. So as an FYI if they say they want to serve you with a summons, ask them to please meet you immediately. Which they will not be able to... then say, please give me your contact information, I'll have you serve it to my lawyer. Whether or not you have one. Then when you call them back, record the conversation if you can... it will hold up better in court. Because even if you owe these people money or not, it is absolutely ILLEGAL for them to threaten YOU or ANY OF YOUR FAMILY members. If enough people take action, these people will be punished... they did a huge story on people like this on Dateline. I encourage people to file with the FTC online, your state department of Justice (which handles phone calls and harassment) and write your DOJ representative for your state to take these pigs down. GOOGLE: western new york capital, it'll show up as "PAY YOUR BILL" and get the contact information. Call them, threaten to sue them, tell them you're a lawyer, ANYTHING...
These people even called me at my JOB! Which is even more illegal. So whatever you can do, do it and document EVERYTHING!

...by the way, this debt wasn't even for me. many of you sound like you are in similar situations. If it is your debt, I encourage you that from my family's experience... to ignore them. If they call ignore the messages... basically if you do talk to them, or have to... say "I'm recording this conversation for legal purposes, please explain the legality of your "summons" someone called for." They're going to tell you there was a "mix up" or something. Explain what you are doing, if you are a family member of the debtor, tell them kindly, that they are illegally harassing you, and if they want to get a hold of the debtor than that is their problem, and you are not responsible for this, no matter what they say. When I told them I was recording, they hung up on me the first time, then I called back and explained if they called me or my family again, that my best friend is a district attorney and I would sue them for every penny they've ever collected from anyone and have nothing to show for it.
Stick up for yourself and be aggressive. Please look up your rights in consumer law regarding debt and contacting family members... it is VERY illegal.

Once you receive it, reply with a debt validation letter through the certified mail. I don't think you have reasons to worry right now. Just don't let them scare you and pay without proper validation. And, as it has been already discussed in this thread, no one can go to jail for non-payment of debt.

They were from India or something. I was not nice to these guys at all and as soon as they knew i was on to them they startted to cuss and get loud. I filed a police report. I also called information being the number showed up as Florida and it was coming out of Hollywood Florida so I think they are using an internet phone because there was no landline to this number hope this helps.

I took out a loan with them and paid off early with a different account than the one on my loan application. They said it would take two days to clear, they say this everyday and it has been 9 days. I began to worry that on my application i filled out an authorization for one time debit from them. I think they are putting me off on clearing my first payment until my direct deposit goes to my checkin so they can take the money from there as well. that way they get paid twice, but do know how much difficulty I would have trying to get it back from them. So I called my bank and had a stop payment to this company on my account so they cannot do that. I will see if they try. My direct deposit is monday.

this just happened to my son. They called his grandparents home and got both of them very upset. You shouls be able to call the FBI and Attorney General's office for the state that you live in and file a complaint. You can also call the Secretary of State and file a complaint with them also. They will tell you if they are liscened to cllect in whichever state you live in.

yes. they can sue you. However, IT IS NOT ILLEGAL TO NOT PAY THEM BACK. However, they can collect and add fees like any other debt in compliance with your state laws.

so either you haven't read the whole thread,or are just trying to intentionally spread bad info.these people are in INDIA,and can't do a thing.if someone was going to be charged with fraud some scammer wouldn't call and want money.in short the people from INDIA can't do anything.let me give a true example.
these dopes called me around halloween.left messages that i was going to be charged.the counts went from 18 to 53 to 85.all in 2 days.the messages got funnier too.like i had better call or else.totally pathetic.so please either read the thread or don't come on with wrong info.
