Payday-Loan-Yes.com has sent my account to an attorney! HELP!

I made a horrible decision to take out a payday loan in November 2007. I was in a tight spot and needed help. Anyway, I was unable to keep up with the payments I borrowed $300 from these psychos. I tried calling and letting them know that I didn't have the money and when I would have the money and that didn't work. I became overwhelmed because my account went into the negative. I closed the account. Revoked the wage assignment and did everything I could to get back on my feet. I didn't hear from them again until last week when their collection "law firm" called me at work and left a message. When I didn't answer they called my mom's house and left her a voicemail about the "civil claim" against me. I lived in Indiana at the time of the loan. I spoke with the Indiana Dept. of Financial Institutions and spoke with a really nice guy who informed me that Payday Loan Yes aka Global Payday LLC is not licensed in Indiana. He said that they will threaten me with court, garnishment, jail, FBI, etc. But that there is nothing they can do because according to the Small Loan Act IC24-4.5-7 the loan is null and void and unenforceable. He said to them them that I talked to IDFI and be firm. I did that when they called my mom again today after they left me a voicemail. I asked them for an address so that I can send them a C&D letter (they wouldn't give it to me). I told them that I cannot receive calls at work and they need to stop calling my mom. They got mad and told me that if I send a C&D that they will issue a judgement against me. They told me to repeat on their recorded line that I acknowledge that there will be a judgement against me. They said that the Small Loan Act doesn't apply to them. I said "for your recorded line I am requesting that you not contact me at work and do not contact my mother at all". They got mad and I hung up. When I get back to my desk they call again but they were just breathing on the phone and shuffling papers. I looked up the number 614.586.4174 and the only that comes up is US Family Mortgage in Ohio. I think I'm okay but I'm worried that they really will enforce this garnishment. Is there anything else I can do?


First of all Indiana DFI is right, so calmn down. More then likely they sent your account to some off shore bottom feeder collection agency who is not an attorney at all.

Second when you sent your first round of letters did it include a wage assignment revocation? If not I'd fire one off and give one to your HR. Secondly if your still unsure check with Indiana DFI again and file a complaint with them. Give them the numbers that they are calling you from. If you can, avoid answering your phone at work, and save all voice mails. (this will help if you decide to sue them for violations of Indiana laws as well as Fair debt collections act).

But most importantly get that wage assignment revocation written up and handed to HR.

Yes, these people are illegal. They are not licensed to do business anywhere in the U.S. They were harrassing me and I contacted the Delaware Attorney General's Office. I have not heard from them since then. File a complaint with the Delaware Attorney General's office.

Payday-loan-yes is an illegal offshore business. They are not legally licensed to do business in any state in the U.S. They recently sent a collection agency after me, but after I sent the collection agency the details about PDL-Yes, they stopped contacting me. The State of California is investigating them.
