i just got served a summons to appear in court by Capital One / bray & lunsford, PA (attorney).

what am i supposed to do?


Capitol One is nasty to deal with when it comes to court. They will push for a default judgment to garnish your wages or levy your bank account if you are a no show. I suggest you communicate with the Legal Dept of Capitol One. Also stay in communication with the law office that served you and appear in court.

Depending on your court date and the total balance, you may be able to settle before court. It is worth a shot if you have the funds availible. If not then hang tight untill the court date.

*FYI* If you havnt made any sort of payments since 2007 it may not look to favorable your way. Be honest and upfront with the judge and propose a decent repayment plan. Best of Luck :wink:

I was got the summons back in October when we were going through a foreclosure. It costs $200 to file an "answer" in Arizona courts, which we couldn't do, so we were advised to not show up at court either by a bankruptcy attorney. To date, we haven't heard anything more from them. I owe about $6k. Was told that in Arizona Capital One doesn't go through the expense of garnishing wages, they usually sell the debt to a collection agency.

Who knows, just waiting for the day that happens...
