I am a resident of NC. I took out a $350 loan with this company. I had several other payday loans as well. I found this forum and realized that I needed to close my bank account which I did. I have defaulted on this loan and have offered them a payment of the principle amount of $350 by mail only. They have refused to accept payment by mail and have repeatedly refused to give me a copy of my contract. I recieved an email today from collections and they have told me that they will supply me with a copy for $35 which I must supply a credit card number for payment. I wrote back to them telling them that I will not send a payment except by us mail and will not send a payment at all until I get a copy of the contract that they keep referring to. I have also sent a revocation of wage garnishment to them and my employer and a C&D letter. I have informed them that I am submitting a complaint to the NC Attorney General's office complete with all correspondence from them. Does anyone have any other suggestions on dealing with them? They are very rude and impossible to deal with! Thanks.


They have been harassing me by email and by phone at work even after the C&D letter. This is the latest exchange after I asked for the 8th time for a copy of my contract(which was not printable when signed and has since NEVER been supplied to me) and a physical address for payment.

I responded:
I will no longer deal with this issue. I do not appreciate your sarcastic remarks. IF you were a legitimate company you would of provided me with a copy of my contract from day one. I will not give you access to any of my personal accounts and I will not pay to have a "copy" of something that I never recieved. This is NOT theft by deception. I am offering to pay what I have borrowed. I have made my final offer and all communication must be in writing, as this is in my best interest. As of today, I am turning in all information to the attorney general. I will not make any payment on this account until I recieve a copy of my contract WHICH WAS NEVER GIVEN TO ME!

The NC Attorney General will be in contact with you and your boss Mr. Stuart Davis. Your lending tactics are shady and abusive and your customer service is even worse!

They responded by calling me at work again! I promptly hung up on her. She quickly responded with an email saying that she would try again tomorrow and another email stating:

Blah Blah Blah. Your account has been marked a refusal to pay. This will
soon go to a collection agency anyway. You taking this loan out, and
receieved the moneis deposited into your account then closing the bank
account SURE is theft by deception. You have a good one. When you feel like
being responsible call the office another rep will work with you.

So, I have sent information to the Attorney General's office. How do I handle the constant harassment? Any suggestions? They refuse to comply with even the simplest of requests. They also refuse to give me even the first copy of my contract-why? The typos in her email's are funny...guess that's the caliber of employee that I am dealing with!

A pre-paid card is a good idea...had not occurred to me. They have agreed to the principle payment but still insist on a $35.00 fee to send me the contract?!?! Also, they said that they would "freeze" the remaining balance on my account. Should I insist on a paid in full letter and the contract before I send a payment? I have already sent a complaint to the Attorney General and will send complaints to the FTC and BBB today.

Sorry, forgot to login the previous post is from me. I do not think that I should send anything without an agreement to mark this account paid in full after the principle payment. I should also have this in writing, right? Do I insist on the contract? I would like to have it to supply to the Attorney General. Thanks.

First, thank you to ALL of your for your help! What a great community!

First, I want to get this straight...

I am in Missouri. I currently have a PDL with Payday Loan Yes which, I understand from reading this board, is an illegal company. I have overpaid them by hundreds of dollars and need to get out of this endless cycle.

First, I need to contact my bank and either put a hard block or close my account.

Second, I need to send a letter, via email will do but also via regular mail, that orders them to cease and desist the automatic debits. The letter should also include info to revoke my wage assignment and I also need to ask for a refund since I'm overpaid by hundreds of dollars.

Is this correct? Is there anything I should do that I haven't included above?

Thanks, again, for all the help. I feel relief already although I realize that is premature when dealing with this company.
