Hi Everyone. Well I had a loan with Pay Day loan yes. I made payments totaling 210.00 for a 350.00 loan. I know I owe them $140.00 for the principal. I got harassed by their First National securities who cussed me out and all that good stuff. I reported it to the Texas Attorney General. Then now I get a call from someone who says he works for the Law Firm of Goldstein & Rath and they threatened to send a letter to my employer and I let them know that in texas they can not garnish wages.

I told him I have been disputing with this company and trying to settle for the 140.00 I owe. He said the best he could do is for me to settle for 300.00. He now called me today and said they were going to go ahead and send a judgement against me and such. Now what do I do if PayDay loan yes is an illegal company? I'm not too sure if they are in Texas if anyone knows, please let me know. Let me know what your advice is.

I'm not sure if they're legal in Texas either. Go to the DFI site in your state and look them up. This will let you know if they're legal or not. I'm sure someone else will come along soon and post. I saw that no one had posted and I didn't want to leave you hanging.

Most importantly, you need to find out if they're illegal. If they are illegal you only payback the amount you borrowered.

hiya--

first of all, there is no such thing as "sending a judgment against you". Thats a big load of BS. There is only one way they can obtain a judgment against you--they must sue you and have you served a summons for the amount they claim you owe. Payday lenders and those debt collectors that collect for them are famous for pulling this crap. Also, being that someone from a "law firm" told you this, I have to seriously question whether it really is a law firm or just a debt collector posing as one. For one thing, a law firm is not legally allowed to use such threats. For another, a debt collector is not legally allowed to impersonate a lawyer or a law firm in any way.

I just searched the TX bar association website, there is no 'goldstein & rath" on file as being a legitimate law firm. Could you perhaps post a phone number for them, off of your caller ID or if they left you a number to call back? I have a feeling that youre being lied to by a debt collector, and Texas has the toughest laws against this kind of thing anywhere in the country. If you can post that phone number I will try to identify who it really is thats calling you with illegal threats.

Texas also has some nice consumer laws (plus all lenders have to be licensed with the state to lend money to any resident of Texas) I don't recall off hand where it is but there is a website that allows you to look up and see if a lender is licensed.

You can send them a DV letter, citing Texas Finance Code. It states that they have 30 days to validate the account and that they must cease all collection activity until they validate the account. Also Texas has a deceptive trade practice that allows you to treble any money you sue for when you sue them for violations....so say they have violations worth $1000, you can sue for $3000 due to that. It makes them stop and think. I have done it.
