My husband is going to close our bank account today. Will this stop them from taking money out next Friday. If they do they will wipe us out again. Can they reopen the account and get money after it is completly closed. They are all illegal in Indiana


That is something you have to talk to the bank about. Some bank close it down and it is locked for good. Others require a 48 wait while still other can take six weeks.

It really depends on the bank.

He needs to speak to the bank manager and stress that it needs to be a hard shut off and nothing can open it.

My husband is going to talk to the bank manager today and tell them to close the account and put a hard shut on it. The loans are not due to be taken out till next Friday. We have not had money to pay our utilities and get groceries for two pays and he recently lost a second job. I am severly disabled. We have till the 16th of April to catch our house payment up or the foreclosure will start. We go to a bankruptcy lawyer tomorrow. My husband is going to send copies of the Indiana law to these people and tell them that they are not authorized to take any money out and to supply us with an address. If we can not stop them I am nursing home bound. I have fought 21 years to stay out of one. I did not realize how bad things were till Saturday when he finally told me about how they had been stripping our bank account more and more since January. It hurts that he never told me back then what he was doing. We went thru this in 2000. But our house never got in jeapoardy.
I hope it all works. I thank everyone for their help. I am not computer savy. So all the help has been so appreciated

We went to a lawyer yesterday. We are getting ready to file bankruptcy. He was not sure about a 13 or a 7 will find out on the 8th. You can file on payday loans. My husband emailed the letters to the loan people and sent them copies of the Indiana law on payday loans. Come to find out that all but one of them had the same postal mailing address. In California. Also closed our bank account and went to another. The lawyer said that was smart to do. I am going to try to get the lawyer to go a chapter 7 because this marriage is over. If he goes a chapter 13 I will be stuck for another 5 years. I found out that my husband was hiding even more lies yesterday. It costs $3,500 in lawyer fees for a chapter 13 and only $750 for a 7. Why?
I am broken in so many ways. I have been married for 25 years to this man and I feel I have never known him. I told the lawyer that I was not aware of all the loans and all the pay day things and credit cards till last Saturday. He just looked at me. When you are as disabled as I am you can not follow someone around every second and you hope that the person you love is truly doing what he or she should do. As he said I am his wife so that makes me equally responsible. How is that fair? I never seen the money. He never paid the bills I gave him money to pay from my SSD check. How is it fair?

I am so sorry that this is happening to you. I spent three LONG years with a complusive liar and it was one of the reasons I got back into the payday loan trap.

I know how much it hurts to be lied to and to basically finacially ruined by it.

I will keep you in my thoughts. You can get through this but it is going to take time.

See, my friends... sadly, there IS a time when bankruptcy may be the only overall solution... I still encourage all of you to follow the advice of and use the information provided by all the GOOD people on here... Yes, Pearl, the attorney makes a killing on a chapter 13, but mine is over 36 months, so this was a better alternative. It put finality to indebteness I would NEVER find my way out of (made up numerous payday loans, cash advances, credit cards, as well as underhanded spouse activity).... and $130.00 a month is better then $1,000 - $1,500 in additional and unnecessary expenses.

Thanks to you all. Does any one know how they handle a chapter 13 when you are seperated? I am leaving for Philly as soon as the creditors meeting is over. My neice has offered me a home and finally some peace after 25 years. I figure he made them he can pay them. He even put up my sons car since it was in his name and my son has yet to know.

To everyone, I should clarify that $1,000.00 - $1,500.00 figures I cited were also made of exhorbitant interest payments, "unfair" assessments and, according to THIS forum, outlandish and perpetual interest charges from illegal pdl's. It's not like I have the difference between $1,000.00 and $240.00 (correcting my total monthly BK payment) to blow every month, but rather now I am able to ensure things like rent, groceries, car-related expenses, etc. may ALL be paid for...
