US Fast Cash still calls after C&D and DV Letter. What should I do?

I borrowed money from US Fast Cash. I paid back 1 payment on a $300 loan. I explained to them that I am unemployed and I am dealing with health issues(recently diagnosed with breast cancer). I told them that I would pay the principal back but they refuse to take my payment for the balance and the amount the say I owe and need to pay is $1096. I sent them a letter via certified mail w/rtn receipt requesting validation on how they got to this amount and to please stop calling me and my family & friends everyday. I am already stressed out and not sure if I can sue them for violation of FCPA because they continue to call. If anyone can let me know how to proceed. I have already filed complaints with FTC, Alabama Attorney General, and BBB. If anyone can help I am too sick to worry but they keep threatening me about this and I just don't have the money to pay right now.

Hi Shana,

If you look at RipOffReport you will see many of the same complaints about this company. They totally ignore the BBB so that is a waste of time. The government is investigating them because of complaints to the FTC (but frankly, those are in small numbers - only 9% of complaints to the FTC in 2008 were in regards to creditor issues (only 1% about credit cards). While the numbers themselves went up, the percentages got skewed because of the #1 complaint: identity theft. The scammers are coming out, so many are scurrying around trying to get any money they can while they can.

So, I guess what I am saying is that unfortunately, outside of paying them off exactly as they wish, these PDLs are like leeches and will not leave you alone. This one is illegal so they really don't care about the law.

The FDCPA is only applicable to 3rd party debt collectors, the original creditor can call you as often as they wish (although some states have enacted legislation much like the FDCPA which is why you should also file with your State Attorney General - as you did). The FTC is trying to expand its powers to deal with original creditors. Hopefully so, they are wonderful.

And not only that, in the State of Alabama they can only charge a max of 17.50%. See the PayDay Loan Laws for your state.

I would tell your friends the situation, that they are illegal scum and that they have no claim and anything they threaten to your friends or family is false. I also have a loan with them, paid them more then the principal value of the loan, but they claim that I still owe almost 3 times the amount I took out.

My friends and family know not to pick up their calls. As the above post says, they can only threaten and even then they are idle threats.

Don't let these scum worry you, take care of yourself and fight the breast cancer not this illegal PDL company!
