So I call this guy, and he answers the phone "Detective" but "catches" himself in the middle of the word so only says detec...this is David Bernstein. So I tell him who I am and that I'm returning his call. He says he is calling me from the "Check Fraud Division" of A S & Associates. Says that his firm has been hired by the National Money Store because of a PDL that I commited fraud on.
He went on to tell me that I owe them $1135 per their records and that they have asked him to prosecute. If I do not pay them at least $567.50 plus $22.70 in "legal processing fees" by Friday at 12 noon (I questioned the time zone and he said "Oh yeah...that is noon central time so you have til 1pm eastern time ) they will put in a request to prosecute and come to my work and serve a warrant for my arrest.
I questioned him on the amount due and he told me that there were 7 attempted ACH withdrawals that were declined by my bank (because I put a stop on all ACH's.) and that they would be $30 each. He then said that I had originally borrowed $500 and made one carryover payment. (He didn't know the amount and I haven't looked it up yet.) I said...well, that totals only $710 and you are telling me that I owe them $1135?? What are the other amounts? I assume there is SOME interest in there, which I would acknowledge, but not THAT much. Per his records, the $500 was credited to my account on 12/29/08. He said they tried to debit my account for $116.66, $141.66, $500, $116.66, $283.83, and $47.22...so I owe all of these amounts too! I advised him that these amounts do NOT add up. He couldn't give me an explanation, nor could he give me a phone number for the National Money Store but told me that they are in Houston, Texas and I could look them up on directory assistance.
The way we left it was that I was going to come up with $567.50 by Friday and call him back with a credit card number.
He also said that I would be charged with a class B misdemeanor and that they could not garnish my wages in the state of Florida unless they could prove I had a second form of income...which I don't.
So my question is....what do I do now? Where do I start? I've read a little and realize that they may not be justified in what they are saying and that I am probably NOT going to go to jail over this, but what are my rights? And what are their rights?

I know that I DO have loans with:Geneva/Roth, Sagamore, Vince Enterprises, CMG Group, and Sandpoint Capital. I think all together I have 11. I KNOW..ABSOLUTELY RIDICULOUS!!!

Let us take the time to do some research on the companies you did list.
Some other member may be along that already know the status of these companies.
The company that is calling is making empty threats and harrassment. You can not be arrested or put in jail for a debt.

The detective can make threats all day long. Next time that you speak with him instruct him to send you the following information:
1. Copy of FL license for the lender.
2. Copy of his license to collect in FL
3. Copy of FL Statute that allows for prosecution for a PDL not paid. *** Please note, Bad Check Laws DO NOT allpy to PDL. When a lender "knowingly" accepts a bad check, they forfeit thier rights under Bad Check laws. ***
If he cannot provide all 3, let him know that you will be more than happy to see him in courts when served. One of two things will happen, either they will go away or they will file small claims and you have your chance before the judge to demonstrate that the lender is unlicensed and the debt will be rendered uncollectable by the courts. Don't worry, it won't get to court with an illegal lender, they will go away!!

I agree they will most likely go away once you let them know that you are aware of your rights and the law. Do not let them intimidate you in any way. Debt is a civil matter not criminal. Keep us posted.
