If I close my bank account on the 6 online payday loans what legal issues will I have?


First of all, please list the following information so we can help you.
-Names of each pdl company.
-Whether they are store front or Internet.
-How much you borrowed.
-How much you paid so far.
-The state in which you reside.
I'm sorry to tell you this, but there is only one sure way to stop the withdrawals, and that is to close your account. If that isn't an option, then tell the bank to put a hard debit block on your account. What a crock the Kansas Bank Commissioner's office is. They went after one out-of-state lender and everyone acts like they are some sort of consumer protection heroes. Meanwhile that office PROTECTS the 100 or so lenders that operate FROM Kansas REGARDLESS of whether they have Kansas licenses. I actually sent them a complaint about one of their companies and they told me that - even though the company operates from Kansas, charges twice what Kansas law allows and had unlimited rollovers, that no KANSAS law was violated so they weren't going to do anything. I guess corruption is alive and well in the heartland.

I took out those online loans to pay my interest and pay down on another loan with discount america that I have arrangements with.

I spoke with the manager at Advance America. I have paid them an estimated $1500 over the last year. I have stopped payment on the check and have been making payment on $575 loan, it is currently at $330 dollars and there is no interst being charged on it. The manager says that I can keep making small payments on it. I think I have paid enough, I live in Kansas. Please advise on what to do???????????

Advance America is legal.

You do need to continue the arrangements with them.

Is your account closed? If not then be careful. I made arrangements and was paying and then bam they deposted the check I wrote them and it cleared leaving me with no money. The money was in there for a rent check.

They did refund the payments I made but I was way short and had to take out another loan at another place to make it through the two weeks until I got paid again.

Just be careful. The manager may come in and run your check again for the heck of it. If I had not had the money I would have gotten a NSF from my bank and ANOTHER $25 fee from them for a bounced check.

If they account is not closed then stop payment on the check.

We had loans thru this agency. They harrassed me to the point that it factored in my losing my employment. I had asked them to quit calling for the same and they did not comply. We offered to make payments as we had the money but they said the payments were "not enough". Also, while looking at KS statutes it says "A lender shall not make more than three loans to any one borrower within a 30 day period" I think they were giving us a new loan every week till we fell into where we could not pay it? Did they fault the statute?

Now they have filed a small claim suit against us--Any suggestions on actions/

What company are you speaking of?

Also, your statement about them being a contributing factor to your dismissal would require this to be stated in the reasoning for dismissal. If it was and you can prove that you told the party not to call, you may have a case for restitution. If you can PROVE that this was a reason AND find the company that was calling, you may want to explore.
