what credit cards do you owe? How long ago did the CA contact you? did you ever recieve anything in writing? you have the right to ask for debt validation.

The original creditor on the one I'm talking about was Ameriquest, when it was charged off it was HSBC. I did get a letter back in Dec. it says original creditor was Matrix, which I have never heard of, and no I didn't respond to it, I know now that I probably should have. I have disputed it on my credit report, they have yet to respond to the credit bureau, I kinda feel like thats why they have been calling me so much this past week, usually I don't hear from them but maybe once a week and sometimes its several weeks in between calls. I got really angry the last time they called they called me at work and I have already told them not to call me at work and they did anyway. I called back and left a message that I was reporting them to the FTC for calling me at work when I had already told them not to, after that happened I didn't hear from them for several weeks.
did you make the report? i tend to report whenever collectors do
did you make the report? i tend to report whenever collectors do anything wrong..
i am not an expert in any means and perhaps someone else can help but i think i would send the debt validation anyway.. does anyone think its too late? i one time sent a validation letter for something i actually already paid on, which conventional wisdom tells you not to do. they than sold me off to another company, and i am still battling with it.

Yeah, I did file out a report of the FTC.gov and list the representatives name and everything. My debt is not a whole lot compared to some others that I have read about, this one here is 1400.00, but when your broke your broke, I wish I had had the money back before it was charged off, a collection agency for the creditor offered to settle it for 762, which was what I actually owed minus all the fees, but I couldnt come up with a lump sum and still couldn't. I may try sending for DV. I owe the money, i just don't know whether it would do me any good to try and work something out with them or to just let it go.
well the thing is just because you owe the money to the creditor
well the thing is just because you owe the money to the creditor does not mean that you owe the money to the people collecting. for example, i one time made a settlement to a company i believed was collecting for american express. it turns out that no payments were ever posted and they were not really collecting for them. i am all for paying what i owe but after being burned like that, i want to make sure i am paying the proper amount to the proper company.
Wow, that would be bad to pay someone and it wasn't who you were
Wow, that would be bad to pay someone and it wasn't who you were suppose to be paying. Do you think it would do me any good to send for DV now? What info will they provide me that proves they are the ones that I need to pay?

In Texas you have some rights. For one, you can DV any time, not just within the 30 day window. Plus, the CA HAS to respond to the DV within 30 days or they have to remove the account from the credit reports. Before making any payment arrangements you shoyld send a debt validation letter to make sure you are paying the right people.
Also, if you include the written notice from Texas Business & Commerce Code, chapter 17, then if they fail to comply, you have them on deceptive trade practice and not only can you sue them for the violations, you can sue them for TRIPLE the amount.

Very interesting information, I did not know. What I also don't know, what do they actually send for DV that proves they are the ones I need to pay? Where do I find this written notice from Texas Business & Commerce Code, Chapter 17?

I guess I'm a little restless, I want to call them, but I don't want to mess up. I really feel like the reason they have started calling is because i disputed CACH, LLC on my credit report, because before that I hadn't heard from them is several weeks. So I think they are wanting info from me a way for them to verify, because I disputed another one on my credit report and they have already responded, but so far CACH has not. I want to try and work this out, but I don't want to give them any more that I have to, plus I have all calls go to my cell phone, I have never gotten any calls at home phone from the various debt collector that have called me over the past you and now these people have called my home and they shouldn't have had my number there, I didn't answer it, because I don't want them calling me at home. I feel like the next step will be for them to contact relatives and yes that would be embarrassing to me. Anyway, just blogging here I guess, need to get if off my chest.

You really should send that DV. You can look at my blog, the sigg below has the link. I have a sample dv letter that is Texas specific. Google Texas Finance Code and then look down to debt collection. Then Google Texas Business & Commerce Code and click on chapter 17.
