i live in mo loans w/ advance america 500 kwik kash 500 ezmoney 500 all store locations i get about 10 calls a day from the same 3 toll free numbers but today a call came thru private and the guy stated he got my case and theres a summons for me but didnt leave name or calalback number can you go to jail over this im really worried any info will be thankfull


sounds like a scam. the state of mo isnt going to call you from 800 and private #'s to tell you they have a summons. i had a similar situation about 7 years ago where i defaulted on a store front (in the state of mo) and i got a letter saying if i didnt pay it by a certain date they would put a bench warrant out, i had to go to the court house and pay for the bad check. dont want to scare you and i'm not sure if they can even do that now, but this was about 7 years ago. i'm sure alot has changed since then.

The calls you are getting are probably from an employee with there local offices.

Have you attempted to repay the loans?

These are all Legal storefronts and they do hold the rights to sue you for nonpayment. I suggest you call back the lenders and find out the status of your accounts, try to work out a payment arrangment if possible.

Since they bounced first then you should be okay against anything criminal.

The MO law states...

Which you did neither.

Now as anyaroberts stated they can file in civil court. So your best bet is to contact the corp and make payment arrangements.

the bank close my account because i was overdrawn hmm from the fees i just kept all my money out can they garnish your wages take you to jail any of the above im a single mom just got caught up in other bills its so hard im still scared now since you said they are all legal storefronts do they usually file in civil court i read a post here they usually wouldnt since the most they loan is 500 and its not worth going to court anymore info thx a bunch appreciate it and the man that called can he get in trouble for stating theres a summons out on me i watched dateline last nite and those collectors told a couple in tx they were w/ a police dept and in reality was not is that legal for them should i keep the messages

The legal lenders have to file a case in civil court and have you issued a summons.

A summon will come by a person of the court, not through an email or over the phone.

They can do that but many do not as they turn it over to in house collections. Even though they are legal they still can get nasty and threaten you.

The ONLY way they can garnish is to file in court, get a judgement and then garnish your wages.

That takes at least a month and it costs them so many don't. They turn it over to collections first.
