Details: I missed a payment to Dr. Cash payday advance and contacted them at the same time that I would have the money to pay them in a couple weeks. They e-mailed me to check up when I would be paying them back and 3 days later I replied that I had the money and was ready to pay (this was past January - 2009).
They e-mailed me back that the debt was already assigned to a collection agency but took a long time to let me know who the collection agency since I had not heard from the agency itself. Dr. Cash gave me the amount I was supposed to pay ($981) and a phone number near the end of January of the collection agency they were working with. I called that agency and they said they had no record of any account they were collecting for me. I then figured I could only deal with Dr. Cash directly, immediately sent them a check for $981, which they cashed - I have a copy of the canceled check.
In the meanwhile I started to get phone calls and just recently a letter from another collection agency that said they had my account with Dr. Cash and wanted somewhat over $2000 to settle. I had sent them a copy of the canceled check and e-mail from Dr. Cash telling me how much I owe, but I don't know if that letter got to them before they sent me the collection letter.
Anyway, my general question is stated in the beginning of my post - if I pay a creditor an amount which they stated is the amount I owe - even if that amount might be mistaken (I thought I would owe at least between $1000-$1100), and they accepted the payment by cashing the check, is my debt considered discharged, no matter what the collection agency is claiming? Do I have to go to court to defend myself?

I would keep on top of this one. Keep everything! You may need it for future reference. The cancelled check is good but always try to get a signed letter from them before you pay them. A letter stating that the account is paid in full. You may still be able to get this. Ask them and tell them that you have a copy of the cashed cancelled check and would like them to send you a PIF letter. It kind of sounds like they took a settlement amount to payoff the debt. Settlement amounts can often be mishandled and need to handled very carefully. (legally speaking) They can and will mishandle (illegally) these settled for less debts! I say harrass them to get what you want and need from them now because the longer you wait the harder it will be to accomplish.

Sry, this stuff really bothers me and I realy want you to get this worked out... Argh! Don't wait for them to sue you again for the same debt, get proof that you paid it now. Paid the amount that they said was due. (get that in writing!) Always get everything in writing with these people because all they do is lie)
