I have 4 credit cards with Bank of America totalling $51,000.00.  My last payment was made at the end of December and I am unable to pay my minimums so I called them requesting a settlement.  They offered me a lump sum of $19,500.00 and said they could not go any further.  They did not ask nor want to know why I could not pay or want any specifics.  I advised them I did not have that kind of money and requested that they settle for 20%. They said Bank of America does not settle that low.  They still call daily and I am not sure if I should just keep calling with the same offer or wait and call every few weeks.  I explained if I had that kind of money I would be happy to give it to them but they did not budge.  I am SO afraid of going to collections and dont know the best route so I can keep them from going there. I assume it will take time for them to lower because from what I am reading they never accept the first offer, I just dont know the timeframe to keep calling them with the same requests.  Any suggestions would be great.  Thank you!!!


You may have to wait it out a bit longer to get a lower settlement offer. Try telling them WHY you can't make your minimum payments any longer. If they believe that your income has been reduced, and isn't likely to change in the near future, they will most likely work with you. They have to believe that you could possibly walk away from the debt (bankruptcy).

nice offer at this point....like sunny said....you need to say why....loss of income is the best.....(if there is a best excuse) but don't threaten bankruptcy without telling them why you are now unable to pay.....my BOA accounts went to Hanna after 120days and I was able to get 35%....I took it and my last payment is this month.....yea!!!!

I just settled with BofA last night one day before charge-off for 25% over 3 months.?? I kept in contact with them since I missed my first payment and kept explaining to them why I could not longer make my minimum.?? I have a medical condition that soaks up most of my available cash and I've lost one of my jobs because of it.?? BofA HAS to believe your hardship.?? They offered me 50% at 120 mos, 35% at 150 mos and then 25% last night.?? Because they accepted TARP funds they can no longer do settlement payments longer than 3 months.
How long have you had their cc??? The manager I spoke with last night told me that has a lot to do with how low of a settlement % they will offer.

Thanks for giving me some hope. I have been a customer for MANY years and always paid on time. I lost my job and have a P/T job making 1/4 of what I used to, but even without my CC minimums already am in the negative 2000 each month. I tried telling them this but they had no interest in the specifics. Would it be best to send it in writing? I am not sure if they really look at the letters. I wish I could get them down to where I can give them the payment before the government makes any more changes!!

HOw long of a time period did you have to come up with the cash?

Biggest thieves are the credit card companies and banks. Can't wait until the new regs go into effect in 2/10. That's why they're jacking up their fees and interest rates now..... raising rates on existing balances, just because they can. They're trying to get every nickel while they can. and these were the ones the gov. bailed out.

It would have been better for the gov. to give bailout money to the consumers so they could pay off their credit card debt. The consumers would have paid their bills, the credit card companies would have gotten their money, and everyone would be happy.

hey just got hold of a good rep who was actually willing to help me.
She is going to ask if they will settle at 25%, and do it off a debit card (safest way , as you can dispute it if they try to pull a fast one) I should know by Monday.. Im sure hoping as it will be a great relieve and then I only have one Citi left , and the first Citi they were super easy to deal.

Please see threads about Senior Accounts number for FIA......I tried to settle with BOA and was getting a different story each time I called until someone here posted the Senior accounts number and I called. I settled about $60,000 worth of husbands BOA cc debt for on 4 accounts for between 25-27%. And they were very nice!!! If you need Senior Accounts number.....post the question in a new thread and someone will respond I am sure....I will look for the number.....I have been settling for the last 3 weeks and am still recouperating!!!

Dear DSTB: I was about where you are when Ben posted that number above .....(I believe it was Ben...I owe a world of debt ...not pun intended ....to quite a few people here)...

anyway, I had called several different numbers and got a hold of a few BOA reps who and every time it was different...eventually after getting the Senior Accounts # .....I got a wonderful gal who helped me a great deal. Respectful....spent a lot of time with me.....very understanding, empathetic...even told me about her problems with debt!!! and we were able to settle 4 of my husband BOA/FIA accounts at 25-27%

Specificallly:
$21,000 settled for $5,200
$27,000 settled for $6,800
$13,000 Settled for $2,700
$24,000 Settled for $8,500

I am so grateful...we were going to file BK for sure...paperwork ready to go for Chap 7 until I found this site. Good possibilitiy we would have lost our home...that was the only bill that my husband was not delinquent on.
We settled these at about a little over 120 days late....one may have been before that.....Hope this helps and gives you hope. Just tell them your story of hardship.....We borrowed from my family to help us ....I am so thankful!:D

Congrats on the settlements! I know what you mean about being thankful. I was so thankful when I found this site and was able to settle my accounts and avoid bankruptcy. Avoiding bankruptcy is good for everyone - the creditor gets some money instead of none, the debtor feels better for having been able to pay something toward their debt, you don't have a bk on your credit report possibilty preventing you from getting a job, house etc and it's much easier to rebuild your credit than if you had filed bk.

Dear DFTB,
It actually happened to me that I went for a new job and they wanted to check my credit report....I was 90 days into not paying a whole bunch of debt....and I was so ashamed I just let it go! When I came on here....I got relief!! I never thought of settling ....and some of the ideas on here really helped. and the people especially!!! :wink:
