Even if you have received no dunning letter, I would reccommend sending them a DV letter STAT.?? I would be sure to state, in your DV letter, the fact you have never received the first dunning letter from them.
I reveived a dunning letter from this "attorney's" office; howver, I never received any phone calls from them.?? The funny thing about their dunning letter, is it clearly states it's from "The Law Office of Thomas Landis" in the return address portion on the envelope, a clear violation of the FDCPA.?? I'm not the only person they have done this to, when I Googled him I found several comments throughout the internet from people that had also had this done to them.
The funny thing is, this is the second CA that Pinnacle has sicked on me for an unvalidated debt.?? The first CA they put on tme, I DV'd and received one of those statements on the CA's letterhead advising me the debt was validated.?? I sent a letter back telling them is wasn't properly validated, and Pinnacle just pulled the debt from the first CA and gave it to Landis to collect on.
Plus they haven't updated it on my creidt report to read it as disputed.
My attorney has already sent Pinnacle a demmand letter, to which they haven't responded.?? So they will soon be served suit papers for mulitple FDCPA, FCRA, and FCCPA violations.

Is that really a violation? The FDCPA states:
Using any language or symbol, other than the debt collector???s address, on any envelope when communicating with a consumer by use of the mails or by telegram, except that a debt collector may use his business name if such name does not indicate that he is in the debt collection business.
As "Law Office" can mean many things besides debt collection I wonder if anyone has actually sued and won a case on something like this?

A dunning letter is a collection notice from the CA...a DV letter is a letter from you TO the CA requesting them to validate the debt. If they can't validate, then they can't collect.
If you are sure it is past the SOL, send them a letter stating so. That should make them disappear.

They 'apparently' sent 4 letters, none of which I received, but I discard junk mail quickly. They then called and left a message regarding "immediate action needed".
The debt they are trying to collect is 100% real. They knew where it started, that it was sold to Pinnacle, and are now trying to collect the payment. The total amount due is questionable, as I'm not positive what I owed, but it was definitely in the ballpark.
The guy on the other line pushed me around and into corners with force and legal mumbo jumbo and tried to get me to set up a payment plan. I objected saying I had no confirmation of any kind that this company was legit. He countered with more threats and mentioned them taking further actions.
So, I've made the mistake of agreeing to pay them (verbally) and have no proof in writing. Yet. If they can/will take care of this debt for me, I am willing to pay it. They managed to drop about $600 off what I owe, which I've heard of.
The question is...do I pay them?? Will my payment to this "firm" actually erase my debt from the credit bureau??
This "firm" sounds very shady and I would be much happier paying someone that I had more confidence in knowing it would take care of my debt.

I know that most f you ar sincere in what you are saying; You must keep in mind, a debt is a debt and if you agreed to pay a debt then you are required not only by law, but by ethics. One very big issue now is the economic times. We all know how hard it is to decide between food, rent, utilities and paying some large company that has all the funds in the world. I do understand completly, but! A bill is a bill and it should be paid, when it is paid is the best question at hand. If you are out buying beer, pizza's, a 350.00 cell bill. In short if you have just said screw it then batton down the hatches cause here we come. But if you are strugleing and trying to do what is right then it is time everyone give a little forgiveness!

A debt is ONLY a debt once you have proven it to be a debt. That requires VALIDATION. If a consumer disputes a debt, its time for you and other bottom-feeders to start following the law....period. Lets can the crap already.
I agree that some people try to skip out on their debts, and you will not find anyone here that supports that, certainly none of the "regulars" here do. So there, youre preaching to the choir. But I fail to see, even in that case where the debtor is being a deadbeat, where you get off breaking laws? Who in this world taught you that its ok for you to do wrong if someone else did wrong too?
Proof of Payment
I gave Tom Landis's office my CC info so I could pay off a debt and they said they would provide documentation to me showing that I had paid off the debt, or at least made payment toward it. It's now day three and they haven't done it yet so I'm thinking of stopping the second payment. Are CAs required to provide any proof that the debt was paid off?

Google statue of limitations for written debt in your state and see how long till the debt expires. All of his debts are expired and the money, under law, IS NOT OWED. You are being scammed.
They are being sued at the moment and have multiple complaints against them with the FTC, PA Atty Gen's office, and the PA Bar. His partner was sentenced to federal time. Google his name too but STOP any further payments and contact the bank directly if the debt is even valid and timely- don't pay them!

Got a letter from them dated the 16th of Feb today 1 March - they want me to settle on a debt from 2001?? If I'm right - they can't because the debt is over 7 years from the date that is has been reported to the credit agency???? Please advise. Thank you.

I got a call for them today. They said I had an old CC in the amount of almost $13,000. And, the last payment was in November 2005. I said isn't that close to the SoL? I was told by the rep the SoL was seven (7) years. That didn't sound right to me so I checked the web at creditscoreinsight.com/statue-of-limitations-on-your-debts and found out in Florida SoL was four (4) years. I then sent them a expired SOL letter (http://www.debtconsolidationcare.com/letters/notify-ca-expiredsol.html). The next phone call I got from them was "you are correct, this is past date but we wanted to see if you wanted to do the right thing and pay what you owe".

We received a letter from them today. Tomorrow we will be sending a certified letter/receipt reuested to them. We will be asking for proof of debt (if you go to court they must show it) including signature;a chronology of all fees/schedules to justify what they say we owe;their license information for our state (they must be licensed to sue in your state normally);a copy of the original document I supposedly signed with the bottomfeeder that supposedly bought the debt. Now, having said that, they can file suit after the DV letter but if you request the information and they don't show it, it will get thrown out. MOST IMPORTANTLY, if your state allows, record your conversations with them..tell them you are recording and don't bluff them..do it! Every time I do that they hang up and I don't hear from them for a while. FILE A COMPLAINT WITH YOUR STATE ATTORNEY GENERAL OFFICE FOR YOUR STATE AND PA and the FTC. I filed on another bottomfeeder out of CA and I ca tell you it does make a difference.

My husband had a MC years ago and the bal owing was $300 dollars. he didnt pay it now Thomas Landis is calling and dunning us saying he owes over 1000 dollars. They even called my husbands mom and boy was she upset because they were so aggressive. they told her our number was disconnected and her being 79 years old gave them our number!! so after several (non answered calls) they sent us a letter (two now) threatening etc.. this MC is past the statue of limitations (6yrs).. so how do we get these people to stop? it worries my husband but I told him i will ask you smart people! thanks in advance for your help.

ACTUALLY after reading the above posts that I didnt see when I typed this.. I realize I can send them the letter sol. I printed out that letter .. my husband now says.. he will just ignore all the letters they send us.. and he doesnt want to stir the pot with that sol letter.. I dont know now what to do.. should we just let the continue to send us letters and hopefully this will go away? thanks

These people started calling my parents and work numbers when I was out of town. It took me SIX times to get thru to them today to find out what this "legal matter" was about. The lady kept disconnecting me. They are supossedly from "Tom Landis' Law Office". Now, I don't know any law office that works out of a call center, which is obviously where this call was taking place from! I had to ask him to stop the buzzing noise and the background chatter so I could hear him.
The man I spoke with (ED HEISENBURG) was trying to tell me I owed $4500 to a Citybank account from 1999. Said he was working with Pennecale Credit Services. Here's the funny thing. I asked how long he had my file on his desk and he said since APRIL 26TH and he had just started calling on it in SEPTEMBER. WTF?!? IF this was real and IF it was a time sensitive matter, I doubt it would be sitting there for 4.5 months on someone's desk. All the information he had on me was at my parents address, nothing new and he only had my new phone number because my mom gave it to him.
All of my credit cards have been paid off and I tried to tell him that and offered to send him the copy of my credit report showing it paid off (with everything else marked out obviously) and he replied "So, everything you have ever had in your life is paid off?" Told him with the exception of my student loans and current utilities and rent, yes. I just kept asking him to mail me proof or email me proof and he wouldn't. Said "this matter had to be taken care of by 5pm today". My guess is they are bottom feeders/junk debt collectors trying to scare people into paying old debt that is ready to fall off.

No it will not erase the debt from your credit bureau. It will change it from owed to settled, but (and this is an important but) the time it is reported on your credit bureau starts over, so it will sit there for another 7 to 10 years.
I had a friend that had a debt owed that she did not even know about that had been outstanding for 6 and 1/2 years. They called her and bullied her so she paid it and now the "account settled" will stay on her credit for 7 more years when it would have come off in 6 more months whether she paid it or not!
Check the time it has been outstanding and if the company has written it off as they are important factors. If it is relatively new (say 1 to 2 years old) then I say settle it for as little as you can since these people bought the debt for pennies on the dollar and are trying to make a profit on something the original creditor wrote off a while ago!
I am an accounting PhD and have done the research on these to verify my statements. However, I suggest you do your own research on the topic for peace of mind. I would even talk to a lawyer that offers free consultations as they will provide the best knowledge about it.

They are calling me about a neighbor's debt despite being told not to. Does anyone know their legal entity and address? Heard he is in PA but can't find him in PA Secy of State or Bar Association records. I would like to at least get a judgment against them so I can call and harass them when they don't pay up.

As for the last line, pretty juvenile. CA's if you have a case, settle out of court.
