I respect a consumer who researches the services to which he/she uses. With that being said when you applied for and agreed to the terms of the loan it would have behooved you to read the complete contract you were agreeing to. You are a citizen of the state of Ohio; however the contract was not made in the state of Ohio. The contract was completed via the World Wide Web; the governing law (clearly outlined in your contract) which you agreed to by your legal e-signature is based in the isle and providence of Nevis West Indies Bahamas. When you spoke with Heather on 2/02/2009 at 11:28AM CST, she clearly outlined how the loan works and what the finance charges were, yet you still accepted the loan.

With all the information at hand I am still willing to work out arrangements for the principal that is still owed on your account. We will cease debiting the finance charges of $90, however the account will not be marked “Paid in Full†until the principal amount of $300.00 has been satisfied. You may contact our Customer Service Department 8am-5pm CST Monday-Friday. Our toll free phone # is 1-866-355-7308.

Reply back to them and tell them that the laws of the United State of America and the start of Ohio apply to all matters related to you. Tell them that you do not validate the laws of isle and providence of Nevis West Indies Bahamas and that all US laws still apply and that they are making loans in the US and that they have to be licensed in the US to do business in the US. tell them that you will not pay any fees or interest. And tell them that you are going to report them to the AG of the US and the State of Ohio, to the FTC and the FBI. Do not call them anymore or even talk to them on the phone. just send them that letter and they should not contact you again

They are not asking the OP to pay finance charges. They said they would cease trying to collect, and all they are asking for is the principle amount borrowed. Isn't that what we are obligated to repay? Th Op should pay the amount borrowed

I think the OP has paid many $90 fees towards the loan which count towards the priniciple.
??
The illegal lender is not counting the fees as any payment and still wants the priniciple.
??
The OP only owes what they borrowed. All fees or rollover charges go towards that amount.

That is??a form letter that they send.?? I got the same one when I was dealing with them.?? Be persistant and follow Count Vlad's advice.?? It will work.?? Just because they are outside they US doesn't give them the right to break the rules.?? If they are going to do business in the US then the have to abide by the laws.
Good luck with this and keep us posted.
