Is SJM Marketing illegal? I currently have 7 PDL loans and basing on my old bank account I have paid it off and more. I have tried to put a Hard ACH block on my account but my bank won't do it. They told me to contact them and have them stop it on their end. I have racked up over thousand dollar of NSF fees. Below is an email from SJM Marketing. I only had a $300 and now they are saying I owe $665. This is crazy. I need help.
Attached is my email from SJM Marketing:
Hi Abigail,

We do not accept payments by mail, but we can take payments by credit or debit card as long as the repayment plan is agreed upon in advance. Our processing company charges a $2 fee for each payment. Once the debit attempts from the 27th are returned to us from by your bank, you will have a total of $665 due in current and past due amounts. What sort of payment arrangement were you wanting to make?
Thanks,

John, SJM Marketing

John,

Since the account is closed the transactions are going to bounch back to your company. I do not have a banking account. I will need an address to mail apayment. I have already told you I do not have an account. Please send the address and stop the transaction. Once I receive an address you will receive a payment. I will like to settle this because obviously I have overpaid. I only had a $300 loan and I paid $540. I do not want to renew this.

Regards,

Abigail

Hi Abigail,

Your account is not considered paid, as I've already endeavored to explain to you. If we are not contacted to include a payment towards your balance, we are only authorized to debit the finance charge on your due dates. The finance charge does not apply towards your balance.

Thanks,

John, SJM Marketing

I have sent an email stating my bank is closed due to illegal transactions done my account. I have asked the bank before I closed the account to check the payments made to your vendor. I have paid $540 for a $300 loan. This is considered paid. I have paid what I borrowed and more. Any further communcation should be done thru email. No calls should not be made to my work, cell, or reference numbers. I have put a claim with the BBB and FTC and my old bank is aware of the transactions and they are investigated this.

These people have already taken a lot from me and they are still saying I owe them....they are crazy.
Here is an update from the bank I have gone again to the bank. I have told them I have reported them to the OCC. Once they heard I reported them they said they are going to look into my account. The manager can see at the NSF overdraft in my account and she said she is personally is going to look into this. As of now I really don't trust the bank and certainly not those PDL companies. They will do anything just to get more money. I told them I am tired of the round about from being transfered from one department to another. I told them because of your employees in that branch telling my account was closed but it wasn't you caused all these fees in my account. All she can say was she apologizes for what has happened. I have told her I have tried to close my account but I have been denied my request every single time. I told her I will pay what I need to pay but I need this account to be closed or just to stop these transactions. She said she can't she will need her boss to authorize it. I told her I need to see her boss but he was not there. At least I was able to talk to a branch manager not a representative. I honestly don't think they know anything else or they are just pain lazy. I am going to keep going into that branch until this is resolved. They still did not put a block on my account but least they are aware they have been reported and the OCC is now on there case.

Ya! as Nohiogal said.. keep going back. If you call, ask for the branch manager, if they ask "is there anything I can do" tell them the branch manager is already handling it for you. that USUALLY gets them to transfer you to them.
Did you??give a wage assignment revokation to your HR? These are completely volentary. If you didn't I'd get one written up ASAP and handed to them. Tell them that you were a victim of fraud on your account and if they get any calls they are not to talk to them.
Also wanted to add, the calls will eventually stop, especially once DFI gets ahold of them and tries to contact them.

They can not garnish wages. They need a court order to do that , and since these loans are illegal in NJ that will nit happen.
As far a wage assignment there is no set form. Just write a letter saying that you revoke any and all wage assignments that you may have signed for them or any of their affiliates.

Thanks for the info. I just got a phone call from the manager from BOA. They put a freeze on my account....finally ....and they have credited all those NSF fees in my account. The branch manager is waiting for the credit to hit and then she is going to officially close the account.I guess they are nervous because I told her I reported BOA to OCC. Now they are sucking up....they automatic changed their tune.

My account is still on freeze because they keep on trying to submit different amounts. There were 2 companies that tried on Friday 4/3 but for each company they submitted 5 different transactions. So a total of 10 transactions. I am glad my account is still on freeze. I have the branch manager monitoring on a daily basis.

I don't know how it happened but B of A put a hold on my account. What a blessing!

I have still not heard anything back from the complaints I have filed with B of A. I do not expect to hear anything from them but you never know.

I have not heard from most of the illegal pdls this week - is it possible that the silence is deadly? or is this just the game they play?

I also receive numerous phone from International Payments Services. I never heard of this company but when I went into my old bank account...they have take out over $400. I never ever heard of this company. Is this company part of another PDL company. Now I receive voicemails they are going to report me to my employers and they are going to garnish my wages. They call about 3 to 5 times a day. I have not returned their phone calls. The people who call have really deep accents and you can not hardly understand them. I need help on this. I don't understand how they are going to garnish my wages if it's illegal in NJ?

because they are not.they will threaten that, but try to send a wage assignment.that is different from a garnishment.if you haven't already.get a wage assignment revocation letter to your HR or payroll person.they won't garnish because they will never take legal action.being illegal hinders them in that way you know.

Wow I didn't know International Payments Services is just a call center....they keep on calling and keeping leave VM's but I keep on deleting it. The guy's name is Max and he calls about 3 to 4 times a days saying he is going to garnish my wages and legal action is going to be taken. Max can't speak english...you hardly understand what he is saying. Am I taking the right step by not answering his phone call?

They can't get your account information unless you apply for another payday loan.

That is how some people have gotten their new accounts hacked. Many of the companies are sister companies and they thought they were appling for a new loan with a different company when in fact it was the same.

Once they got the new information they took the money from the new account.
