A collection agency says that $1860 was charged off by OC in 2004. Then they say that interest on the account commenced accruing on that same amount 4/07. It looks like the OC sold the account 4/07. So my question is where is all the interest from 2004-2007? What creditor stops accruing interest!!!!


I'm not an expert in any state but BOA would be able to accrue interest after Charge Off, late fees and OTL fees can accrue until CO. If they sold it, they would also, assign the right to accrue interest to the JDB. You likely tolled the MO SOL with the move to CO. Do you ever intend on moving back to MO?

Yes, we plan to move back as soon as our house gets sold.

One of my credit reports show a charge off amount of $567 for that account, but I don't want to have to bring that up as evidence because #1 it is just a credit report and # it isn't even the same account number they say is originally held by BOA. #3 CA still hasn't produced any signed contract or agreement between my self and OC.

Should I not worry so much about the interest and just focus on requesting discovery for a signed by me contract or agreement?

Yes, I requested a pretrial conference (this Monday) just in case I needed to request discovery. Since the time that I requested pretrial conference I have received (through disclosure) everything that the plaintiff plans to use as evidence at the trial. All of their evidence looks like hearsay stuff.... I wonder if I should just turn down my right to request discovery since I think I have everything I need.
