TRYING NOT TO GO POSTAL OVER PDL'S!!! HELP
Date: Fri, 04/03/2009 - 19:06
I am in Texas
Current Loans:(all online)
AmeriCash Advance owe $612.50
Pay Day One owe $736.15
Cash Net USA owe$313.27
The 1st two are both due 4/10 and the last one 4/27. I have been renewing and renewing only to see that the balances have not went down AT ALL. Right now I am overwhelmed and have no idea of how I am going to get myself out of this trap. I have been renewing them because if I were to allow them to go thru, my financial situation would be worse off than it already is. Its to the point to where I can hardly afford to put gas in my car because my finances are all tied to the loans and trying to keep current on regular bills(rent, childcare, etc). I do not know what to do at this point or know how I am going to pay these off. All of the pdl's are current and I was trying to keep it that way for fear of getting my account into a mess and destroying my credit. On other post I read about freezing the accts.,hard blocks, deposit only accts., etc. How would this work for someone like myself who is setup for automatic bill payment (auto insurance)? I am trying not to be too long winded, but I could really really really use some HELP or DIRECTION!!

Hi, I searched the data base for AmeriCash Advance, both as a CSO and a payday loan, I'm not certain if they are licensed or not, I need to do a little more research to find out.
The other two you have are licensed, CashNetUSA operates as a CSO and PaydayOne is licensed as a payday lender. This means you will need to make payment arrangements with them. Ask if they will give you an EPP plan (extended payment plan), I am pretty sure that both will. First you will need to revoke their ACH rights, this is perfectly legal but you need to send them a letter (email should be fine) and revoke their right to debit your account, also show a copy of this letter to your bank. In that letter, include a request for the EPP due to financial hardships your family is facing. Offer to pay them via money order through USPS.
Based on some of the information I have researched at this forum
Based on some of the information I have researched at this forum I believe that AmeriCash Advance is legal, however, they are also members of the CFSA, which means you would be eligible for the EPP plan with them also. I would include them when you send letters to revoke their ACH rights.

I was asking about the letter to revoke the ACH rights. In the email that I will be sending what exactly should go into the request to revoke the ACH rights? Also, after taking a copy of the letter/email to the bank is their a specific request that I need to make with them such as requesting a block or freeze to my account?

Could someone please give some insight as to how to properly write the letters to revoke ACH rights. Please, I am really trying to send this information off before my loans are due... I also need to know how to go about making arrangments to pay them off. Can I have it setup to where I would be responsible for sending them payments on my own, oppose to them taking from my checking account (which has already caused me so much grief with staying above water on other bills). Someone please advise.....
camspoppsa, I sent you a PM, hopefully that will help. :)

Hi Shazzers or anyone who may be able to assist, today I contacted the bank (Compass) and asked them about the hard debit block..they acted if I was speaking another language. Does that work the same as a freeze? The lady mentioned a freeze to me but told me that something like this could only be authorized if there was illegal activity on the acct. Since I did authorize the pdl folks to deduct from my acct. upon takin out the loan. Would this not allow me to do anything to stop them from debiting my acct.?? The date for the loan to go thru is gettin closer I just really was hoping that there was something i could do.

You have the right to revoke the ACH transactions three days before they are due to post.
Can you just close the account?

Thanx, so much for the info. I will be going back to the branch shortly and sending my letters to the pdl companies. Hopefully all goes well. I will post and let everyone know what happens.

Just wanted to say thanks Shazzers for your informative information. As a result I did call the bank and received ACH information. I then submitted my letters to the pdl companys and was surprised to received such quick and NICE responses. The first was from AmeriCash Advance which offered me a plan that would only be for the principal and the removal of any fees. The entire loan was due Apr. 10 with no extentions. As a result of showing them I knew my rights, please see their response below

Yeah, its pretty reasonable for me. I just couldn't see myself having to renew one again for probably the millionth time and paying the other off in full because there were no more extensions. Now I can get some sleep and start to smile again :)
