Hello. I live in the state of Pennsylvania. I am being sued by Patenaude & Felix law offices on behalf of Capital One Bank. I owe $1,443.12 plus interest as of November 2006. The debt has been in default since the summer of 2006. The date the complaint was filed is Sept. 13, 2008. They electronically signed the complaint and gave verification. The date it was filed to the local prothonotary was Feb. 13, 2009. I didn't not recieve the notice until Feb. 24, 2009. I looked through it briefly and disregarded at first. I didn't notice court date so I figured I still had time to take care of it. However in fine print was the whole "20 days to defend by written action" disclosure. It has been far more than twenty days. On March 31, 2009, I received another letter from said law firm with an "Important Notice" attached. It states I'm in default because I didn't have a written appearance , and I have ten days to act or they are gonna have a judgment against me etc. This again is electronically signed. Long story short, I was wondering about my rights. I will be seeing a lawyer in this matter the beginning of the week. I live at home with my dad, and I do not have any property that is mine. At this time, my wages are already garnished for my student loan debt. I do not make enough for them to attach my wages further to pay this debt. What other things could they do to collect on this debt? If additional information is needed, I will be happy to provide it if I have it. Thank you.


The PA law does not permit garnishment of wages by the creditor to recover credit card or other debt. However, wages can be garnished for recovery of Federal debts and alimony and child support obligations. So I think that you need not worry about garnishment of your wages by Patenaude & Felix law offices.
