Pretrial delima help!

I requested a pretrial conference (this Monday) just in case I needed to request discovery. (debt collection case credit card account) Since the time that I requested pretrial conference I have received (through a disclosure statement) everything that the plaintiff plans to use as evidence at the trial. This is ALL that the plaintiff is allowed to use at trial so long as no further discovery is requested or required. All of their evidence provided to me proves nothing and is hearsay stuff.... I wonder if I should still request the discovery. If I don't request that they plaintiff produce a signed contract can they just say that I never asked for it through discovery? I am leaning towards demanding that they produce this but I'm still not sure.

ALWAYS ask (via discovery) for everything that proves the debt is yours. Their failure to disclose is a strike against them and makes the use highly unlikely.
