Are you talking the actual creditor or a collection agency?

sorry...meant collection agency...anyone ever sued one?

Heck ya...several times I have attempted to sue to have it settle out of court quickly. We did it with and without an attorney.

I sued one and it too settled out of court; however, the CA turned around and violated the settlement by selling the debt, that was part of the settlement, to another CA. I attempted to go after them again; however, they had conveniently changed into another CA.

I am currently pursuing two more CA's for multiple violations. They're still pending, but I'll be sure to let everyone here knows how it works out when they're finished.

did you file suit in your local courthouse? Or did you have to file where the creditor resides? WHat court did you file in..small claim..muni...ect?

For me, it was my local courthouse and it was in small claims court.

For most of mine, I just sent an "intent to sue" letter with copies of violations...tapes, statements. They just forked up. The one that we actually filled on, an attorney handled. The settled out of court.

I Guess I should have specified, the one I did sue was actually located in the same city as me. Once they were served, they were really quick to settle.

the other two CA lawsuits are still in the "intent to sue" phase too. They have, I think, 30 days to respond and time is just about up.

I have had attorneys handle all three cases. I'm just not that smart when it comes to these things. I'd probably make more money for myself if I did; however, I'm not really suing for the money. It's more the principle of the matter!

Seems like there are quite a few people who have successfully sued collection agencies. Thanks for sharing with us Florida that is interesting. What kind of attorney did you get for this?

Collection agencies that routinely violate the FDCPA routinely settle out of court as part of the cost of doing business. I succesfully sued two with an attorney. Both settled outside of court. I think FloridaRon and I share one of the same attorneys also!
