I have the same questions as joeblow posted on sunday, febraury' 09 but i am in California. I was making payments on my judgment (Attorneys Office), but my hours at work were cut and i couldn't afrord to pay them. They were unwilling to work with me and therefore they want to garnish my wages and if they do i'll be out on the street! what is the proper proceeder i will need to take for CA law? If any one could guide me in the right direction maybe i can sleep better at night.

Please help me!

Hi Shells,

Welcome to the Community!

Print out this Claim of Exemption form, fill it out, and send 2 copies to your levy officer (the one assigned by the courts to oversee your compliance - it will be on your court documents), not the court itself nor the creditor nor their attorney. For assistance and information on how to fill it out, read the State of California's Employee Instructions document. You will also need to fill out a Financial Statement to go with that request.

Either that or file for Chapter 7 bankruptcy right away.

Hope this helps.
