I received the followng email from Payday Services today. I live in Maryland and originally borrowed $ 750.00. I have repaid $ 456.25 to date.

[quote]Dear Customer:

It seems apparent that you have chosen to ignore all our efforts to contact you in order to resolve your debt with Payday Services. At this point you have made your intentions clear and leave us no choice but to protect our interest in this matter.

If we do not hear from you within 48 hours of the date on this letter, we will be compelled to seek legal representation from our in-house attorney. We reserve the right to commence litigation for intent to commit wire fraud under the pretense of refusing to repay a debt committed to, by use of the internet. In addition we reserve the right to seek recovery for the balance due, as well as legal fees and any court cost incurred.

We believe that this was not your intent and that these steps are unnecessary. We merely require you to contact our recovery asset location department at 800-420-8025. We are willing to negotiate an arrangement, possibly for less than full balance. This arrangement will halt any further action from taking place.

Thanks,
Linda Rumbaugh

I have not refused to pay, but have advised them I am not able to discuss this matter while at work, which is the only place they call me. Additionally, I told Billy there last week that I was not able to make any arrangements at this time and if they needed to turn the account over, I understood. I got a call the next day from a Dina and advised her of my conversation the previous day. Everytime I have previously tried to make arrangements with this company they have insisted on payments I knew I could not make and I told them that. They refused to give me a physical address to mail money orders as well.

I will be in a position to repay the amount owed at the end of May. I believe their email is just a threat but do wonder if there is any way they can go after you for wire fraud.

Any input would be appreciated. Thanks.

Payday loans are prohibited in the state of MD. You are only obligated to pay $294 and not a penny more. Furthermore, an illegal payday lender won't step foot inside a US court room. Have you contacted MD's DFI regarding this?

Have you also closed your account/drafted wage/and Ach revocations?

I have done all of the above except contact the Department of Financial Regulation. They have not been too harrassing, just a phone call everyday at work, and I tell them the same thing, I am not in a position to make arrangements at this time and I don't won't to promise something I know can not be done. I will contact the DFR on Monday since they are now resorting to threatening me. I'm just wondering if they can file an action for wire fraud as threatening to take an action they can not legally do is also illegal.
