I have a quick question. I am in the middle of disputing TL's with the CRAs. An old utility bill came back verified. I am in Ohio and wanted to know if someone can tell me the statute that utility bills would fall under?

Are utilities considered open accounts?

If someone can please help me I'm trying to figure out who to send my 623 letter to

thanks so much for the quick reply. it is so confusing when you are just getting started with repair and all the info you have to learn. the 623 letter....im assuming is the letter asking for an investigation after it has been verified through the credit bureau

okay I guess then my other question would be to get it off my credit report do I send the letters to the CA. One of them is Allianceone-utility bill, and the other is UCB for Time warner cable. The bill for UCB was included in my BK. it's scheduled to come off next year, but I was trying to get it off quicker

so I spoke to time warner cable which is the original collector for the UCB account. The rep I spoke with says that they have an account with me opened 2003 the balance is 359.00 and then she starts to say the balance was brought down to zero, and quickly corrects herself and says no it's really 359.00. I said well I never had an account with you, do you have any type of written contract that I signed? She states that they dont have written contracts all they need is a name, a social, and an address. I state so any one can open an account in anyone's name? She says "YES!" and then goes on to say I see someone else tried to open an account in your name at said address in 2007, but we wouldnt open it. I asked her for the name of the collection agency and she said hold on a moment, and the line hung up.

Should I write a letter to their legal department or CEO asking them to verify the debt or delete? Im just baffled at how easily you can get an account in someone's name.

Here's something I would draft.. you can fit it to your needs.

In going over my credit report, I had noticed that there was an item in the amount of... from Time Warner cable listed. Since I knew I didn't have an account with you, I immediately disputed it with the CB's, which came back verified. I then contacted customer service in which, I explained to the rep that I never had an account with Time Warner Cable. The Rep said I had one opened in 2003, again I want to stress that I at no time in the past or present have had an account with Time Warner Cable.

When I asked the rep if they had anything signed by me authorizing service all they need is a name, a social, and an address. If this is true, then this leaves open the chance of identity theft, which is clearly the case here as the rep also said someone tried opening up another account in 2007 under my name. I would like this matter taken care of, as I have stated I have never in the past nor present have had Time Warner cable


Btw, as a side note.. anytime I've had Time Warner cable come out to install new service, i've ALWAYS had to sign a order form for them. ALWAYS. Not sure if that's how they do it in other areas though.

Took a bit of digging but here's the CEo's e-mail/phone/address

thanks so much for the info and the letter. The funny thing is I filed for BK in 05. The CA-UCB has it listed as included in BK with bal of zero. , but TWC is stating that I have a balance of 339.32. I just called and spoke to another rep who is stating that the account was open in 04. So conflicting info right? she also states that UCB is just assigned the debt and they dont own it. So how is it that UCB was able to verify if TWC is saying I owe, and UCB states the balance is zero? Plus since they are only assgned the debt are they still able to validate and report on CR.

So you had time warner at one point? I'm confused, or was it simply you pulled your credit, and whatever was on there, you included in BK? Does it say somewhere on there (Usually on the side) Filed chapter 7 Bankruptcy? (or whatever chapter it is?) If it does, then I don't think you can dispute it because it was a valid debit and it indicate that it was included in Bankruptcy.

No I never had TWC at all. When I filed BK my BK atty pulled my report and I just signed all the paperwork. Im guessing that if it was on my credit I didnt know because I had so many things on there. The thing is that UBC is saying its included in BK, and TWC says I owe a balance. If it is only assigned to UCB wouldnt they still need to contact TWC to verify? and if so, then they are showing two totally diffrent balances and account open dates.

I guess Im just really confused, even though I know the accounts not mine since it may have been included in my BK am I stuck with it?

I'm thinking so, since basically you didn't try verifing it before including it in bankruptcy. I'd contact a lawyer at this point and see what your options are. Maybe someone else will have some more insight.. but hosestly talking to a laywer would be your best bet because of including it in bankruptcy.

I put a response on here but I dont see it....I never had a TWC account at all. Im not sure if it was on my CR and my lawyer just included it, but still TWC says I still owe and UCB says it was included in BK shouldnt they have same info, besides the fact its not mine

It should. My guess is that UCB didn't forwarded the discharge paper to TWC. I'd see if you can get someone that handles Banckruptcies at TWC and forward them the discharge papers.

Though, what i'm still unsure of, is how the lawyer got UCB included in the bankruptcy if the debt isn't yours without pulling a credit report. Did you just get a collection notice from them and didn't dispute it and include it in your bankrtupcy?
