Hi and welcome. FL is known to have CSO's (Credit Service Organizations), it's important that you differentiate the CSO's from the payday lenders as CSO's do not follow the pdl laws. I will take a look at some of your lenders to see which are licensed to lend to FL residents, hang tight!

At first glance, I don't think any of yours are legal but I will need to double check. Meanwhile if others have info about any of these lenders please feel free to post it.

I think these are roll over but I am not sure. Can you explain the terminology for rollover. At least 3 of the PDL I have had since August of 2008 and I have been renewing the loan every two weeks.

I believe rolling over is the same as renewing.

From a quick search, I believe East Side is illegal.

If some of the PDL are illegal, what is my 1st step.... I am about to drowing paying these fee every month. My next payment are due on 4/15/09. I am paying out like 600 every paycheck.

I found SDS OF WEST FLORIDA INC in the database but the license is expired.

I found MMG but as a mortgage broker.

You best bet to be sure is to contact the Bureau of Regulatory Review with questions, call 850-410-9895; or toll free consumer helpline at 1-800-848-3792 (option 1).

I have been working on a letter to send to the different companies. Can somebody please review my letter and let me know what you think

After doing research regarding Internet payday loan laws in the State of Florida, I have found that your Internet payday loans are actually illegal. I have also found the following laws to be true applying to payday loans in the State of Florida in general:


The Florida State laws are very specific:
Any person or company who does NOT have a Florida License under either Title XXXIII (REGULATION OF TRADE, COMMERCE), Chapter 560 (MONEY SERVICES), or under Title XXXIII (REGULATION OF TRADE, COMMERCE, INVESTMENTS, AND SOLICITATIONS), Chapter 516 (CONSUMER FINANCE) is operating ILLEGAL in the State of Florida!

I hereby revoke any and all ACH authorizations with your company from debiting any of my personal accounts, per Federal law, Regulation E Section 205.10 Preauthorized transfers. I have closed my account with Washington Mutual to protect my interest in this matter, per instructions from The Florida Department of Finance. I also revoke any and all wage assignments I may or may not have signed with your company, I no longer authorize you, your company, or your affiliates to attach any part of my wages or contact my employer for your collection purposes. I have notified my employer about this matter so any attempts to do so on your part will be rejected.

I demand that any contact be made through US Postal mail or email only. I will need everything in writing to keep accurate records of all communication as per instruction from my Attorney General's Office.
I prohibit you or your affiliates to contact me via telephone at my place of employment or my home
telephone number. I also prohibit you from calling my references listed on my loan.

Due to the fact that Internet payday loans must be licensed in the state of Florida to be a legal and binding contract, your company should NOT issue loans to Florida residents at all. I am requesting that you send me your license number which enables you to offer loans to Florida residents.

The legal amount that could have been charged to my loan is the principal amount, even IF your Internet pay day loan were legal anywhere in the U.S.. I am willing to pay the principle amount of the loan only, however, this is only if you provide me with a physical address where I can send payments.

I must also inform you that I will be filing complaints with the Better Business Bureau, the Federal Trade Commission, and the Florida State Attorney General's Office.

I expect a response from your company no later than 5 days from the above date regarding this matter. This response may only come via US Postal mail or email. No telephone contact is permitted.

I have 3 pdls. I have looked on the Florida website, but either I am looking in the wrong places, or just don't know what or where to look to see if they are illegal

The PDL's I have are
East Side Lenders - $400.00 ($520.00 w/finance fee)
Ashland - $200.00 ($260.00 w/finance)
Kenwood Services - $200.00 (260.00 w/finance)

I think Ashland and Kenwood belong to the same parent company. PWEST ??

So here is my current problem...I call ,email and fax Ashland , Kenwood and Eastside on June 12 and tell them I have a problem with payment for the 15th due to a bank problem, (frozen acct) , and I need to reschedule the payment .the rep at Kenwood responds that I didn't do it with in 3 business days and to call on the 15th with another form of credit and I respond that I can't as my direct deposit is halted , I need to open a new account with my payroll check and there fore the bank will not issue monies for my out of state payroll check for 2 days. She (Kenwood person) responds, you just need a form of payment and hangs up. On Wed, I call her and she says I didn't respond within 3 Business days.,I said I did.. Acct frozen on June 11, I call PDL, they are closed, I call/Fax/Email on June 12, and ALSO ..nowhere on there contract does it state that 3 business days does not include weekends or holidays! she informs me they are closed weekends! duh.. ok.. it should state that!! well where I work we are open 7 days aweek!..anyway
I tell her I want to make a payment and janeyette says she sent it to collections.. I didn't call on Monday with payment.. blah blah..we go in circles..AGAIN, I ask for a supervisor, she states SHE is the only supervisor... says l will now just have to wait for the collector to call... well,, a week goes by, and I still fax and email them asking for where to send a money gram to pay this off.. and I get an email today from Matt, telling me to call Redco, as I am in collections on this,. he signs it Matt i-collect...

So.. I borrrowed the monies to pay these people off, but they will not respond to my calls or emails... Are the above PDL's illegal and where do I go now..

PS: EastSide did call and set up a payment schedule,but it went up from 400.00 to 620.00 - 128.00 every two weeks till paid !! fees and adding an extra week, etc... And Ashland gave me a Money Gram acct number to mail the missed payment to... they did work with me on Wed.
I am soooooooo stupid sometimes.. I have talked to a budget person and have FINALLY set up a budget..but this was just a stupid thing to do,
