pdls in las vegas - wage garnishments?

i was shocked when my bf called me from work and told me that one of his pdl is goin to do wage garnishment on him. because he havent made payments with them for about few months i believe. some pdl company says threatening words and always scare the hell out of us. some of my pdl's told me that before like LUCKYCASH4U. i was told if i dont pay them soon they will end up doin wage garnishments on my check etc.i didnt get pay'em for a month or two they said if i dont pay them sooner they will do that. well my bf didnt pay them for like 5-6 months i think now they tell him they no longer hold his account they will just do wage garnishments on his paycheck.

my question is, would any of u guys know how the procedure goes for wage garnishments? especially here in las vegas??? how long does it take for a pdl company to do wage garnishments on u?? do they do that when they wanna do it??
what are the steps before they can do garnishments?? how can you tell if a pdl does garnishments on u??


First, what is the name of the PDL?

Second, they can not garish wages with out filing a case in civil court. Once they file then he would get an official summons from the court with a court date. If the PDL wins the case then they can get a garnishment on his wages.

He should place a wage assignment revocation statement at his work. He may have signed on in the loan documents. The wage revocation is voluntary and can be revoked at any time.

Here is a sample of a wage assigment revocation letter he can draw up and give to HR/Payroll.

he said its CASH LAND. i remembered early february he got a letter from the mail from the pdl CashLand. its about summons/goin to court something like that.. but it was dated dec.2008. we didnt get the mail til february 2009. weird huh? so there is no way for him to go to the court because we got the mail late. the court date was dated dec.08 we got the mail feb of 2009??!! so what will happen???

he was calling each and every payday loans he got because he filed for bankruptcy. he needs to gather up all the infos and contacts/addresses of his loans/debts etc. one of his pdl which is CashLand told him they no longer hold his account. thats what the rep from customer service told him. and the guy told him that they will just do wage garnishment and that they will only stop that if they start seeing his bankruptcy case file #.

if my bf is earning 450-500 on his paycheck how much would they take out from that wage garnishment???

So Cashland does not hold the account anymore but they rep their told him they were going to garnish?

Who holds the account now?

If there was a court case from 2008 and he did not show up there would have been a default on the case and the PDL would have won and already garnished.

Did the letter he got about garnishement come from the court or just from Cashland?

A PDL can say all they want but until an offical document comes from the court it is all smoke.

If the letter was from the court then it was not properly served. Most court documents are sent certified mail and must be signed for so they can prove you got the notice. In some counties the baliff delivers the notice in person.

all i remmber was that the envelope was thick. regular long white envelope with pen written his name. theres like buncha papers in it. stating he has a court date on dec. 2008 but its already feb 2009 when we got it. so what will happen next? my bf just told me one of his pdl which is cashland is gonna do wage garnishment because he called the customer service for cash land and thats what that guy told hiim. they no longer hold his account and thats what they will do.

its a storefront cashland here in las vegas. will he still be able to see online if there was judgement against him? because we moved out of our house dec 15, 2008. we didnt get the mail til early february. it is kinda weird. cause court hearing was dated dec.08 but its already 09 when we got it. and since then we never heard from cashland.

i am trying to get all the info i can. i am trying to help my bf out. because he is not earning alot on his check due to tip compliance plus his hours are not that much. how much more will get if some company does wage garnishment. i wonder what will happen for not showing up to court regarding pdls.

Nothing wil happen that he did not show other then Cashland winning the case by default.

You can look online for the city/county you lived in and find the court pages. Most cities have the court cases online and he should be able to find it by his name.

Did he switch jobs since December 08? If he did have a court case and it was defaulted to CashLand then I would think they would already be garnishing his wages.

NV garishment is 25% of the paycheck.

would u happen to know what site i should look it up to?
he never moved from another job. hes been working at his workplace for about 3 years now. i believe he stopped paying his pdl when he applied for pdl assistance program. last time i remember, his last payment was last yr around sept.-oct. cant really remmber anymore.
