NCO harassing my relatives though I've talked with them - help!

NCO Financial Systems has been calling me for several months now. I did take perhaps half a dozen of the calls. I explained my situation and asked for a fax number and street address so my attorney could contact them regarding my case. Each time I did so, they became even more abusive (shouting / threatening) and they would not give me the information. When my attorney's secretary called for the info, they said they wouldn't give it to her because they had no proof the office was representing me! Talk about a catch-22. We needed the fax number so we could fax the letter of representation!
Honestly, it seems like they don't want to acknowledge I have legal representation because then they have to stop hassling me.
Anyway, last night, I received a frantic phone call from my elderly mother-in-law. A man named 'Joe O'Donnell' had called and asked for my number (which she did not give) and told her to pass along his 800-number and that I needed to call him back 'within the hour'. It was NCO.
I spent ten minutes on the phone with Mr O'Donnell. Most of you know the drill, and I don't need to list the insults, shouting, abuse, constant interruptions, etc - the usual bag of tricks. I told him not to call my relatives and he responded (and I quote) - 'I can call whoever I want whenever I want because you won't take our calls. I'll call your mother-in-law tomorrow morning at 8 am sharp.'
So my question is this - I thought they could contact relatives IF they haven't been able to reach the original debtor. They have reached me numerous times. (They didn't like what I had to say, but I did talk with them.) So why are they allowed to call my mother-in-law to ask for my telephone number when they already have it, and have used it to reach me?
And can they keep harassing my relatives like this?

The refusal to give out a fax number is just crazy.
It's a collector. They also called my sister a month ago. I had talked with them before that, and I called them afterwards. So they have done this twice now.
Also, with both my sister and mother-in-law, they called numerous times (6+) per day before they finally picked up. (They both have caller ID and didn't recognize the number.)

Keep a copy of that letter, and send it CMRR, and a fax, that way they can't say they were "Never notified" I'd also let them know that you included the debt that they are calling about in bankruptcy.

When I talked with my attorney just now, he seemed baffled by their calls. 'Did you tell them you're filing? Did you give the case number? And they're still calling you?'
Last night was just horrible. My mother-in-law was upset, and that upset me, and the guy at NCO - ugh. He kept yelling my name - 'Charla!' - and interrupting me. And when I asked for the fax number, he laughed. He told me, 'I know everything about you. I can call your college roommate if I want.'
Then he said, 'You want to go court? We'll take you to court. Your name will be in the paper.' And so on.
I guess I'm just - Hey, if they want to go to court, fine. Take me to court. But cut out all the garbage in between. The law against abusive practices is great, but if it's not enforced, what's the point?

(I'd say when you get the green card back just to be on the safe side, but in the back of your mind, keep the date that you also faxed them if you have to take them to court) you can sue for voilations to under Fair debit collection act. Do you know if your state is a One party state? If it is, let them know that your recording calls. Or just let vm kick in if you know the number. If they keep calling realitives/friends etc, have them keep a log as to what times/how many times a day they call. Once you have all the information once you send the C&D give them to your attorney or find a consumer law attorney and sue them.

As for suing them - at this point, I just want to get through the bankruptcy. The last year has been a nightmare for me. I've had a permanent headache, many sleepless nights, and I probably have an ulcer. :) It's funny in a pathetic / morbid way.
When you think about it, the entire collections process is stupid. If debtors had the money to pay, they would pay. They don't pay because they can't pay. And threatening phone calls and lawsuits won't make money magically appear to pay the bill.
Oh well. I'll take everyone's advice, hope it works, - and I'll keep an eye out for any leprechauns. I could use a pot of gold.

According to Section 804 of the FDCPA (15 USC 1692b) a debt collector can only contact a 3rd party in order to get your contact information (IF you have disconnected your phone and they can't find you, for example), and then only ONCE. (There's up to $1000 in it if you sue them for this clear violation).

My sister's phone number was under her husband's name, too, and she's used her married name for 17 years. But they still found her. And they also found my mother-in-law despite the fact I've kept my maiden name.
I appreciate ChrysHenderson's point. I would love to sue them. But while the intent of the law is great, the use of the law isn't so great. It's simply too expensive to sue.
I would like to point out, too, that despite all of my interactions with NCO, I've never - not once - received anything in the mail from them. Nothing. In the beginning, I answered all of the collection agencies' calls. What a mistake. Not one agency was interested in working with me, or helping me. I asked for a couple of months' forebearance while I searched for a new job. I asked for late fees to be stopped and the interest rates to be lowered and the 'past due' amount to be lowered. I also asked about settlement options. They weren't interested.
I'm not proud of declaring bankruptcy. It's been a very upsetting process. But when creditors will not work with you, what other option is there?
Anyway, regarding NCO, they don't just call your relatives. They harass them. They freaked out my mother-in-law - the guy was like, 'Tell her to call back within the hour! It's a vital business matter!' She was calling everyone trying to get my cell number. It was ridiculous. If I could have reached through the phone and punched that guy, I would have done it.

Well, normally I would say yes, it is expensive to sue. *However*, the FDCPA not only grants you court and attorney costs, but also $1000 for these obvious FDCPA violations. Go to "www.naca.net" and get a referral to a Consumer Protection attorney. I'll BET you can get one to work pro bono.
Not to mention, did you know that they are forbidden by Federal Law to contact you or yours AT ALL as soon as they are notified of your bankruptcy? It's called an Automatic Stay and it takes effect on the date of filing.
AND no dunning letter? NO NO NO in this case it is not expensive to sue, you can get PAID. This one is SCREAMING free money! $$$$$$$$

That's the problem I see with collection agencies. They feel they can get away with it since either they the consumer doesn't know their rights, or they feel that the consumer feels hiring a lawyer is too expensive and don't want to go through the hassel.

I didn't even have to appear in court. All I did was fill out the form the attorney emailed me, signed it, and faxed it back to my attorney. Two weeks later, I got the call regarding the settlement. I should have the check in hand in a few weeks. I am glad to get the money--it will help pay off my debts. However, I really wanted them to know that they cannot keep treating people like this without repercussions. The FDCPA laws are in place to protect us from this kind of abuse. If we do not use them, this type of behavior will never stop.

1111 - when i filed bankruptcy, i felt the same way you did. i just wanted it to be over and live my life again. my attorney brought up sueing a company that kept harrassing me while i was under bankruptcy protection but i kept saying no. and now i regret it, i really could have used the money and i would have won. more importantly, if more people sue the companies would have to start to behave better. i never sued anyone in my life but i really do regert not suing them.

I STILL have NCO calling me,..with debts that are more than 9 ( or so) years old. they claim "this and that." I have also asked them for a Fax number or address.
