Will you legally consider this as ligitimate evidence to validate Credit?


The problem is, i had $6000 when i stop paying credit card (enrolled debt settlement) now, my acct is in collection with amt. of $8000+.

im planning request DV however, if they send me previous statements,would be enough to satisfied my request?

any input greatly appreciated!

In this case you need to see how they came up with the extra 2000 bucks and a signed contract giving them the right to do so. A statement is considered validation when the balance it states is also the balance being collected upon. If the statement you get says you owe $6000, then you need further documentation to prove up the $2000 extra, because so far they only proved you owed $6000, not $8000.

Thanks guys, I was thinking the same thing; however, I didn't want to post that because I was still confused over that. I always presumed the statement had to be close to, or equal to, what the CA was attempting to collect. If there was a big difference, then the CA would have to prove exactly where the difference comes in.

I think a recent thread I read had gotten me confused on that, so thanks for helping clear up my confusion too.

More info on Debt Validation.

The interest is probably added by the original creditor, per the original contract, so they would also have to provide that contract, and proof that they are legally able to collect on that debt. Credit cards will continue to accrue interest and late charges until paid, or they freeze the interest in a hardship program. So the original creditor would have to provide to the collection agency a breakdown of all other charges between the time of the last statement provided and the present time.
